8-3.301 - Emergency Purchases by City Directors.

If an emergency occurs at times other than regular business hours, the City Manager may authorize City department directors to purchase directly any supplies, materials, equipment, or contractual services where immediate procurement is essential to prevent delays in the work of the using department which may vitally affect the life, health or convenience of citizens. Except in events of defense or disaster, the authorized expenditure for each such emergency purchase shall not exceed the amount of five thousand dollars ($5,000.00).

The director of such using department shall submit, as soon as possible, to the Central Purchasing Division a record of the emergency purchase together with a report of the circumstances of the emergency.

8-3.302 - Collusion with Bidder.

Any officer of the City or any department thereof who shall aid or assist a bidder in securing a contract to furnish supplies, materials, equipment or contractual services at a higher price than that proposed by any other bidder, or who shall favor one (1) bidder over another by giving or withholding information, or who shall willfully mislead any bidder in regard to the character of the materials or supplies called for, or who shall knowingly accept commodities of a quality inferior to those called for by the contract, or who shall knowingly certify to a greater amount of labor performed than has actually been performed, or to the receipt of a greater amount or different kind of materials or supplies than have actually been received, shall be deemed guilty of malfeasance and shall be removed from office.

8-3.303 - Collusion by Bidder.

If at any time it shall be found that the person to whom a contract has been awarded has, in presenting any bid or bids, colluded with any other party or parties for the purpose of preventing any other bid being made, then the contract so awarded shall be null and void.
