5.48.010 - Permit required.

It shall be unlawful for any person to hold or conduct a dance on city property, or at any place in the city where an admission is charged, or to permit or allow dancing in any place of business conducted by him within the city, without first securing a permit therefor as provided in this chapter.

5.48.020 - Application for permit.

Every person desiring to conduct a dance requiring a permit as provided in Section 5.48.010 shall first present a written application to the police department for such permit, said application or applications, to be upon a printed form provided by the city. Permits for the conducting of a dance shall be limited to the conduct of one dance for each application, and permits for the permission of dancing in places of business may be granted to continue until revoked by action of the city council.

5.48.030 - Contents of permit.

All permits for dancing shall be in writing and issued by the police department after previous approval of the fire department and building department and shall set forth, among other things, the following:

A. The name of the person to whom the permit is granted;

B. The location of the premises upon which such dance or dancing is to be conducted or permitted;

C. That all dancing and music shall cease at the hour of one thirty a.m.;

D. That no person under the age of twenty-one years shall be permitted upon or within the premises where, and during the time when, such dance or dancing is conducted, if any spirituous liquor is sold, served or given away upon such premises;

E. Such other terms, conditions and restrictions as may in the discretion of the city departments seem proper under the circumstances.

5.48.040 - Refusal or revocation of permit.

Failure to comply with any law, rule or regulation applicable to dances, or the conduct thereof, or the place or building in which they are conducted, shall be grounds to refuse any permit applied for, or grounds to revoke any such permit and, in such circumstances, the police department shall immediately revoke said permit. The applicant or permit holder in such case shall have the right to appeal said revocation to the city council at its next meeting.

5.48.050 - Permit fee.

A fee of ten dollars shall be paid in advance for each event covered by the permit. Notwithstanding the above, no fee shall be required for a nonprofit or charitable organization.
