15.16.010 - Payment in compliance with chapter.

Each property owner who connects to the city's sewer system shall pay to the city, at the time of issuance of a building permit, sewer facilities charges in accordance with provisions of this chapter.

15.16.020 - General terminology.

Words, phrases or terms not specifically defined in this chapter, and having a technical or specialized meaning, shall be defined as set forth in the latest edition of Standard Methods for the Examination of Water and Wastewater, published by the American Public Health Association, the American Water Works Association and the Water Pollution Control Federation. Reference to waste constituents and characteristics have the meanings ascribed thereto in the aforesaid Standard Methods for the Examination of Water and Wastewater, and measurements thereof are as set forth in said publication, or as established by federal or state regulatory agencies.

15.16.030 - Plant component—Rate computation.

A. The connection charge to be paid by each property owner connecting to the city's sewer plant system to defray the cost of the city's sewer plant shall be computed as follows:

Connection charge = Consumer Price Index (USCA) * × Basic Charge

*Base year index (January 2015)

B. The basic charge is ascertained by adding the following:

  1. The average daily flow of wastewater, during any thirty-day period, at the rate of thirteen million four hundred forty thousand dollars ($13,440,000.00) per million (1,000,000) gallons;

  2. The average daily load, during any thirty-day period, of Biological Oxygen Demand, using the five-day Standard Methods test (BOD), at two thousand eighteen dollars ($2,018.00) per pound;

  3. The average daily load, during any thirty-day period, of suspended solids (SS), at one thousand seven hundred sixty-two dollars ($1,762.00) per pound.

C. Information and data to compute the basic charge shall be supplied by the property owner. If the property owner is unable to supply sufficient information or data, or if the information or data supplied is unsubstantiated, then the basic charge shall be as estimated by the city engineer.

15.16.040 - Plant component—Standard rates.

Notwithstanding Section 15.16.030 of this chapter, unless there are circumstances known at the time which would indicate that a different charge should apply, the following basic charge shall apply for the listed uses in computing the plant component connection charge required by Section 15.16.030 of this chapter:

15.16.050 - Line, pump and main component—Rate computation—North of Bear Creek.

A. The connection charge to be paid by each property owner connecting to the city's sewer system north of Bear Creek to defray the cost of the city's trunk line, pumps and force mains shall be follows:

B. In the event the use of a property is intensified following connection to the sewer system, the property owner shall pay the difference between the connection charge for the prior use and the connection charge for the new use.

C. The connection charge paid by "all others" shall be an estimate of the average daily gallons of sewage per day as determined by the city engineer from data supplied by the user. At the end of one (1) full year of full-scale operation, the actual sewage use shall be calculated by using the volume of water consumed, or at the election of the user, by use of measuring facilities installed at the expense of the user and approved by the city engineer. If the actual average daily gallons of sewage per day varies by more than fifteen (15) percent from the estimate, an additional connection charge shall be owed by the city to the property owner who paid the estimated connection charge.

D. Industrial and commercial users who disagree with the rates established in subsection A of this section may furnish data acceptable to the city engineer to calculate an estimated average daily flow, and pay a connection charge based thereon, subject to the conditions established in subsection C of this section.

15.16.055 - Line, pump and main component—Rate computation—South of Bear Creek.

A. The connection charge to be paid by each property owner connecting to the city's sewer system south of Bear Creek to defray the cost of the city's trunk line, pumps and force mains shall be as follows:

15.16.070 - Connection charge north of Bear Creek—Outside North Merced sewer assessment district.

A. In addition to any other fee required to be paid in order to connect to the city sewer system, each property owner north of Bear Creek, and not included in the North Merced sewer assessment district, shall pay a connection charge to defray the cost of trunk lines, pumps, and force mains computed as follows:

Connection charge = (Basic charge + interest from January 1, 1988, calculated on an annual basis based on the previous year's average interest rate earned on city investments) × 1.03.

B. The basic charge shall be ascertained by determining the general plan designation for the property to be connected. The basic charge, for each acre or fraction thereof is as follows:
