§ 5.42.010. Legislative authority and intent.¶
A. The purpose of the chapter is to establish a fee to be collected by the Merced County public defender for providing assistance to petitioners in processing petitions for change of plea or dismissal of charges pursuant to Section 1203.4 of the California Penal Code.
B. Pursuant to Section 1203.4 of the California Penal Code, any county may require reimbursement for actual cost of services rendered for generating and processing a petition for a change of plea or dismissal of charges at a rate to be determined by the county board of supervisors, not to exceed $120, whether or not the petition is granted.

§ 5.42.020. Definitions.¶
As used in this chapter, the following words shall have the following meaning:
"Petitioner" means any person requesting a petition for a change of plea or dismissal of charges, pursuant to Section 1203.4 of the California Penal Code. (Ord. 1757 § 1, 2005)
§ 5.42.030. Fee.¶
A. The fee imposed pursuant to Section 1203.4 of the California Penal Code shall be $111 based on the actual cost of services required to generate and process a petition for change of plea or dismissal of charges.
B. The fee may be imposed upon all petitioners for which a petition is processed, whether or not the petition is granted.
