§ 16.59.010. Substandard lots.

Subject to the granting of a conditional use permit, any substandard lot may be used as a building site, provided that all other regulations of the applicable zoning district shall apply. Substandard lots are defined below.

  • (a) Single-family residential zoning districts, except for the R-1-U (LM) District:

    • (1) For single-story development, substandard lots are those lots with less than five thousand (5,000) square feet of area.

    • (2) For development of two (2) or more stories, substandard lots are those lots which do not meet the minimum required lot width, depth and/or area of the zoning district in which the lot is located.

  • (b) For all other zoning districts, including the R-1-U (LM) district, substandard lots are those lots that do not meet the minimum required lot width, depth and/or area of the zoning district in which the lot is located.

§ 16.59.020. Exclusion of easement area.

For the purpose of determining minimum lot size and the number of units to be constructed on a particular building site, the planning commission shall have the discretion to include or exclude any portion of such building site occupied by any easement, depending upon the extent to which it impairs the use of the property.

§ 16.59.030. Improvement of lands not included in subdivision.

No parcel of land, not part of a recorded subdivision shall be developed or improved and no building permit shall be issued for the erection of any structure thereon until a use permit therefor has been issued by the planning commission. When approving such use permit, the commission may require such improvements, dedications or conditions as may be required by the city subdivision ordinance (Title 15), as well as any other conditions deemed necessary to achieve the purposes of this title.
