3.26.010 - Grant of franchise.

The McFarland Mutual Water Company is granted a franchise to use, or to lay and use pipes, ditches, flumes, conduits, and appurtenances for transmitting and distributing water for all purposes, under, along, across, or upon the streets, ways, alleys, and places within the city for a period of one year.

3.26.020 - Franchise fee and payment of fee.

A. Within three months after the expiration of the calendar year, or fractional calendar year, following the date of the granting of the franchise, and within three months after the expiration of each calendar year thereafter, the McFarland Mutual Water Company (hereinafter "the grantee") shall file with the clerk of the city a verified statement showing in detail the total gross receipts of grantee, its successors, or assigns during the preceding calendar year or fractional calendar year from the sale of the utility service for which the franchise was granted.

B. Grantee shall pay to the city within fifteen days after the time for filing its statement of gross receipts as described in subsection A of this section, in lawful money of the United States, a sum equal to two percent of grantee's gross annual receipts arising from its use, operation, or possession of the franchise or one percent of grantee's gross annual receipts derived from the sale within the city limits of the city of the utility service for which the franchise was granted, whichever is greater.

3.26.030 - Statutory terms and conditions.

All of the terms, covenants, and conditions described at Chapter 2 of Division 3 of the California Public Utilities Code commencing with Section 6201 are incorporated in this chapter by this reference as if fully set forth herein verbatim except for Section 6231(c) and grantee is required to comply therewith. Failure of grantee to comply will subject grantee to the damages described in California Public Utilities Code Section 6302.
