5.08.010 Permit--Form¶
The board may issue an exclusive or a nonexclusive permit to any person, firm or corporation authorizing the scavenging or salvage and removal of refuse, trash, metal, or any personal property deposited in or upon any dump or refuse disposal site owned or operated by the county. Such permit shall be in writing and may be in the form of a contract and may be revocable, or irrevocable for a specific period of time to be stated in the permit, and subject to such terms and conditions as the board may determine. A reasonable charge or other consideration may be exacted for the issuance of such a permit or contract. Any permit or contract issued prior to the effective date of the ordinance codified in this chapter shall be deemed valid as though issued subsequent to the effective date of the ordinance codified in this chapter.

Except as otherwise provided by law, any permittee may claim a lien for the cost of removal and storage of any motor vehicle, or part thereof, from any county owned or operated dump or refuse disposal site. Such a lien may be satisfied by a lien foreclosure sale conducted in accordance with applicable laws and administrative regulations of the state, but the county shall not be or become liable for satisfaction or payment on account thereof.

The county does not and will not guarantee or warrant title to any personal property removed from any dump or refuse disposal site by virtue of any such permit or otherwise. Removal of any such personal property shall not be deemed a sale or transfer from the county, and the resolution of any question of title to any such personal property shall not be the county's responsibility.

No person, firm or corporation shall engage in any act of scavenging or salvaging or removing refuse, trash, metal, or any personal property from any dump or refuse disposal site owned or operated by the county where a sign prohibiting unauthorized scavenging or salvage or removal of refuse, trash, metal or other personal property is posted on or near the entrance to such dump or refuse disposal site by authority of the board unless such person, firm or corporation holds a valid, unrevoked permit or contract from the county authorizing such scavenging, salvage or removal.

Violation of any provision of this chapter shall constitute an infraction and shall be punishable under Chapter 1.20, the general penalty provisions, of this code.
