17.38.010 Generally.

The regulations in this chapter shall apply in all MHR districts and shall be subject to the provisions of Chapter 17.42. (Ord. 2020-07 § 2, 2020; Ord. 2004-05 § 1, 2004)

17.38.020 MHR—Permitted uses.

Uses permitted in the MHR district shall be as follows: A. Residential units, either attached or detached, including single-family dwellings, duplexes, row houses, townhouses, and condominiums. B. Community recreational facilities, including but not limited to tennis courts, swimming pools, playgrounds and parks for the private use of the residents of the development and/or public, provided such facilities are not operated for remuneration. C. Uses, nonhabitable buildings and structures incidental, accessory and subordinate to permitted uses. D. The keeping of domestic chickens pursuant to Section 17.42.160. E. Transitional housing as defined in Section 17.04.711. F. Small residential care homes, including small residential care homes that do not require licensing by the state or county. G. Supportive housing as defined in Section 17.04.698 and subject to the following review timelines per California Government Code Section 65653(b): The city shall notify the developer whether the application is complete within thirty days of receipt of an application to develop supportive housing in accordance with this section. The local government shall complete its review of the application within sixty days after the application is complete for a project with fifty or fewer units, or within one hundred twenty days after the application is complete for a project with more than fifty units. 17.38.021 MHR conditional uses.

A. Large residential care homes or facilities. Approval shall be pursuant to Section 17.58.040 (Use permit action by appropriate authority). (Ord. 2024-06 § 2, 2024)

17.38.030 Site area.

The minimum lot size for the MHR district shall be as follows:

A. Townhomes: 5,000 square feet. B. Detached cottages: 2,500 square feet. C. Single-family dwelling: 5,000 square feet. (Ord. 2020-07 § 2, 2020; Ord. 2004-05 § 1, 2004)

17.38.040 Site width, site depth and setbacks.

The minimum site width, site depth, and setbacks for the MHR district shall be as follows: Regulation Single-Family Cottages Townhomes Minimum site size 5,000 sq. ft. 2,500 sq. ft. 5,000 sq. ft. 17.38.050 Site coverage.

The percentage of building site coverage permitted in the MHR district shall be as follows:

17.38.060 Building height.

No habitable building or structure shall exceed two stories and a height of thirty-five feet. No nonhabitable building or structure shall exceed twenty-five feet. Structures on lots adjoining lots that front on Bayer Drive shall not be sited and of a height so as to be within the viewshed horizon of existing homes on Bayer Drive as measured from a point measured twenty feet back from the rear property line, five feet six inches above existing grade, and a twenty-four-degree angle and a point six feet above the existing rear property line. 17.38.070 Parking.

Excepting townhomes/condominiums, which will be governed by this section, all other parking standards within the Marina Heights residential district shall be governed by Section 17.44.020 With respect to townhomes and condominiums within the Marina Heights residential district, which shall be limited to twobedroom units: One covered parking space for each dwelling unit shall be required. 17.38.080 Open space.

Total amount of usable open space shall be no less than ten percent of the site area. (Ord. 2020-07 § 2, 2020; Ord. 2004-05 § 1, 2004)

17.38.090 Townhomes/condominiums.

In the MHR district, development standards for townhomes/condominiums shall be those in Chapter 17.66, Development Standards for Condominium/Planned Development Projects and Condominium Conversions, open space (Section 17.66.060), minimum lot area per unit (Section 17.66.120), minimum unit size (Section 17.66.130)

and setbacks (Section 17.66.140) standards which shall be superseded by the standards of the MHR district. (Ord. 2023-03 § 3, 2023; Ord. 2020-07 § 2, 2020; Ord. 2004-05 § 1, 2004)

17.38.100 Site and architectural review.

In the MHR district, the development of individual lots shall be subject to site and architectural design review procedures in Chapter 17.56.
