7.08.010 - Permit required.

It shall be unlawful for any person to make or to cause or permit to be made any opening in or under any curb or sidewalk in any public street, avenue, place or alley in the City or to cut into or to remove, injure or destroy any part or portion of the curb or sidewalk in or upon any public street, avenue, place or alley in the City for the purpose of the installation of any driveway or for any other purpose whatsoever without first obtaining from the Street Superintendent a written permit so to do. The permittee shall make a deposit to cover the cost of inspection and restoration of such public curb or sidewalk to its original condition. Driveways shall be restored to a condition conforming to the rules and regulations of the Street Superintendent.

7.08.020 - Driveway construction to conform to approved plan.

All driveways constructed in any improved public street, avenue, place, or alley in the City shall be constructed according to the plan of standard driveways for the City approved by the Council.

7.08.030 - Replacement of curb cuts and driveway approaches.

Any portion of a curb cut or driveway approach on any public street which is no longer needed or used for reasonable vehicular access to the property served shall be replaced by the property owner by alteration and repair of the sidewalk and curb in accordance with the standards of the Department of Public Works upon notice being given by the Director of Public Works to the property owner of the need to do so. The Director of Public Works may give notice to the property owner to accomplish the replacement at the time of an application by the property owner for a building permit or excavation permit or at any other time considered necessary or appropriate in the interest of the public safety and welfare.

The procedure governing the manner of giving notice, the duty to repair, the accomplishment of the work by the City, and the collection of the cost of such repair shall be in accordance with the provisions of Sections 5600 through 5629, inclusive, of the California Streets and Highways Code as said sections now exist or may be hereafter amended.
