Mammoth Lakes Municipal Code Ch. 8.04 Environmental Control

The purpose of this chapter is to implement the requirements of the California Environmental Quality Act, Public Resources Code § 21000 et seq. and the Guidelines for Implementation of the California Environmental Quality Act adopted by the State Secretary of Resources.

This chapter shall apply to each department or office of the Town which is responsible for the processing of projects or the initiation, processing, review or approval of "environmental impact reports" as the same is defined in the California Environmental Quality Act, Public Resources Code § 21000 et seq.

The Town Council shall, by resolution, adopt the objectives, criteria and procedures necessary to carry out the purpose of this chapter. The objectives, criteria and procedures shall be consistent with the guidelines established by the Secretary of Resources, and shall provide for, but not be necessarily limited to, the following:

(1) The environmental review and assessment of Town projects and the preparation, review and approval of environmental impact reports for such projects;

(2) The environmental review and assessment of private projects for which a permit, lease, license, funding or other entitlement of use is required from the Town and the preparation, review and approval of environmental impact reports for such projects;

(3) The reasonable opportunity for anyone interested in any project to review and comment upon such environmental review and assessment and upon such environmental impact reports prepared by the Town;

(4) Exemptions of various projects from the requirement of preparation of environmental impact reports;

(5) The preparation, notice and filing of negative declarations.

The provisions of this chapter and the provisions of any resolution implementing this chapter shall be construed so that in the event there is a conflict or ambiguity between the provisions of this chapter and the provisions of any other code, ordinance, resolution or regulation of the Town, the provisions of this chapter and the provisions of any implementing resolution shall govern.
