12.28.010. - On private property—Property owner responsibility.

It shall be the duty of the owner or representative of the owner or owners of each parcel of real property within the Town to clear off snow, and maintain free from snow, sufficient space on such real property as is necessary to meet the off-street parking requirements for such parcel and structures thereon, as provided in Title 17.

12.28.020. - On private property—Civil remedy.

Upon a second or subsequent violation of the provisions of this chapter and in addition to the penalties set forth in this chapter, the Town, by and through the office of the district attorney, may apply to the Superior Court of the State in and for the Town, for an order temporarily restraining the owners of such property from conducting any business on such property, the order to remain in effect until proof of compliance with the provisions of this chapter is shown or as otherwise provided for by law.

12.28.030. - On private property—Violation; penalty.

Failure of a property owner to comply with the provisions of this chapter shall be deemed an infraction and shall be punished upon a first violation, by a fine of not less than $50.00 nor more than $250.00. A second or subsequent violation of the provisions of this chapter within one year shall be punishable by a fine of not less than $100.00 nor more than $500.00.

12.28.040. - On public property—Disposal of snow on Town streets.

(a)

It is unlawful for any person, firm or entity to dispose of snow on any Town road. It is also unlawful to push snow across or onto any Town road for the purposes of disposing of the snow elsewhere. The term "Town road" is defined as that portion of the right-of-way between the snow stakes. Under special circumstances, the term "Town road" may be defined as, including the entire right-of-way.

The phrase "dispose of snow" includes blowing, pushing, ramping, shoving or otherwise depositing snow on Town roads.

12.28.050. - On public property—Identification of private snow removal equipment.

All private snow removal equipment operating on Town roads shall have some form of identification on both sides of the equipment. This shall be the operator's name or firm name and telephone number.

12.28.060. - On public property—Removing snow on main street landscaped areas.

In order for a business owner or a snow removal operator to remove snow in the landscaped areas on Main Street, they must first obtain a permit from the Town. If it is necessary to occupy the State right-of-way, a permit must also be obtained from Caltrans in Bishop, California. Removal times are from 2:00 a.m. until 6:00 a.m. A security deposit will not be required by the Town unless excessive damage due to carelessness occurs.

12.28.070. - On public property—Ramping snow on Town rights-of-way.

When snow ramps are built that start on Town road rights-of-way, they shall not extend into the roadway as defined by the snow stakes. Ramps constructed in violation of this section will be cut off by Town snow removal crews.

12.28.080. - On public property—Lighting buildings at night.

For safety purposes, in the winter season, all property owners are required to provide nighttime exterior lighting for the front of their buildings that face any Town road. The purpose is to make the buildings visible to snow removal operators, thereby reducing the possibility of snow removal damage to property or persons.
