10.16.010. - Definitions.

Except as specifically provided in this section, the words used in this article shall be as defined in the California Vehicle Code.

Airport user means all persons utilizing the airport for legitimate purposes, including, but not limited to passengers, tenants, airlines, vendors, contractors, and subcontractors.

10.16.020. - Parking regulations—Traveled way.

The traveled way shall be not less than 15 feet on one-way roads, the roads being so marked by signs, or less than 22 feet on all other roads. The traveled way is equally spaced on both sides of the centerline.

10.16.030. - Parking regulations—Violation; penalty and enforcement.

(a)

All bails for parking violations within the jurisdiction of the Town shall be set by resolution of the Town Council.

(b)

The provisions of this chapter, as well as the provisions of the State Vehicle Code, may be enforced by the members of the Town Police Department.

10.16.040. - No parking for more than 72 hours.

(a)

No person shall cause or allow any vehicle owned by him/her or in his/her possession, custody, or control to be parked upon any street (including the right-of-way thereof), alley, or publicly owned parking lot for more than 72 consecutive hours, unless a permit is provided to do so.

(b)

Any member of the Police Department may remove any vehicle parked upon any street right-of-way, alley, or publicly owned parking lot for more than 72 consecutive hours and shall, upon such removal, deal with such vehicle as provided in Vehicle Code §§ 22650 through 22856 of the State.

10.16.050. - Parking regulations—No parking zones designated.

No person shall stop, park or leave standing any motor vehicle whether attended or unattended, except when necessary to avoid conflict with other traffic or in cases of emergency or in compliance with the directions of a peace officer or traffic control device, in any of the following designated areas:

(1)

Locations where the Public Works Director has determined that such restrictions are necessary in order to improve traffic safety or provide for the orderly flow of traffic. Following the resolution of the Town Council approving such restriction, the Public Works Director is authorized to place red curb or signs within or adjacent to such portions of Town streets indicating such restrictions and the effective time periods. Such restrictions shall apply 24 hours a day, seven days a week, unless otherwise indicated by the posted signs.

(2)

Locations where the Police Chief has determined that traffic congestion is likely to result from the holding of public or private assemblages, gatherings or functions, or for other reasons. The Police Chief shall have power and authority to order temporary signs to be erected or posted indicating such restrictions and the effective time period, provided that such temporary signs are erected or posted prior to the effective time period as follows:

a.

At least 24 hours in advance in locations where parking is permitted for portions of one day; or

b.

At least 72 hours in advance in all other locations.

Locations where the Public Works Director has determined that the use of a street or portion thereof is necessary for cleaning, repair, construction, snow removal, or installation of underground utilities. The Public Works Director shall have power and authority to order temporary signs to be erected or posted indicating such restrictions and the effective time period, provided that such temporary signs are erected or posted prior to the effective time period as follows:

a.

At least 24 hours in advance in locations where parking is permitted for portions of one day; or

b.

At least 72 hours in advance in all other locations.

10.16.060. - Parking regulations—Exceptions.

Any emergency vehicles, and any vehicles owned, operated or otherwise controlled by the Town Road Division of the Public Works Department are excepted from the provisions of Section 10.16.050 when such vehicles are being used on official business of the agency to which the vehicle belongs.

10.16.070. - Parking regulations—Removal.

In the event any vehicle is stopped, parked, abandoned or left unattended in violation of the provisions of this article, any police officer or person authorized to remove or cause to be removed any such vehicle and to have such vehicle towed or otherwise removed to any public or private garage or parking area and to have such vehicle stored in such garage or parking area until claimed by the owner thereof.

10.16.080. - Parking regulations—Angle parking prohibited except in zones designated.

(a)

No person shall stop, park or leave standing any motor vehicle, whether attended or unattended, in any manner except parallel to the curb or edge of the street unless the location has been designated for angle parking as specified herein.

(b)

The Public Works Director shall determine the days, times, and portions of Town streets upon which angle parking shall be permitted. Following the resolution of the Town Council approving such permission, the Public Works Director is authorized to place pavement markings or signs within or adjacent to such portions of Town streets in which angle parking shall be permitted, indicating the angle at which vehicles shall be parked. Angle parking, in accordance with the designation placed by the Public Works Director, shall be permitted during the days and times indicated and within the areas so designated.

(c)

When signs or pavement markings are in place indicating angle parking as herein provided, no person shall park or stand a vehicle at that location other than at the angle to the curb or edge of the roadway indicated by such signs or pavement markings and within a single space.

10.16.090. - Parking regulations—Application of regulations.

The provisions of this chapter imposing a time limit on standing, stopping, or parking shall not relieve any person from the duty to observe other and more restrictive provisions of the Vehicle Code or the ordinances of this Town, prohibiting or limiting the standing, stopping, or parking of vehicles in specified places or at specified times.

10.16.100. - Parking regulations—Restriction and limitation on parking.

No person shall stop, stand or park any vehicle upon the street in any one block for a period of time in excess of any restriction or limitation on such stopping, standing, or parking posted on said block by the Public Works Director following the resolution of the Town Council approving such restriction. Compliance requires that vehicles be removed from the block in which parked at the end of the allotted time so designated and not be parked again in said block for at least a three-hour period. As used in this chapter, the term "block" means both sides of any street between the nearest adjacent public street intersecting in each direction.

10.16.110. - Parking regulations—Removal of chalk marks.

(a)

The owner or operator of any motor vehicle exercising the privilege of parking a vehicle on any street or portion thereof where regulations are in effect restricting the length of time vehicles may be parked on a street or portion thereof does so on the condition that the police officers of the Town may place chalk or other removable marks on the tire of the vehicle for the purpose of enforcing such parking regulations.

It is unlawful for any person to erase, rub out, conceal or otherwise remove, any chalk or other mark so placed by a police officer while the marked vehicle remains parked on the said street or portion thereof. For

the purpose of this section, the movement of a previously marked vehicle in such a manner as to cause the tire marking to be concealed or removed, and without leaving the parking space or the block where such vehicle was parked when its tires were previously marked shall be deemed to be an erasure or removal of such chalk or other marking.

10.16.120.

  • Parking regulations—Signs to indicate parking regulations; authority of Public Works Director.

(a)

Following the resolution of the Town Council approving such regulation, the Public Works Director is authorized to place signs to indicate parking, standing, or stopping regulations, and the signs shall have the meanings as herein set forth. Such regulations shall apply 24 hours a day, seven days a week, unless otherwise indicated by the posted signs.

(1)

The term "commercial loading only" means no stopping, standing or parking during any times or days posted for any purpose other than the loading or unloading of freight, providing that the loading or unloading of freight shall not extend beyond the time necessary therefor.

(2)

The term "freight" means goods ordinarily transported by common carrier.

(3)

The term "passenger loading only" means no stopping, standing or parking during any times or days posted for any purpose other than loading or unloading of passengers or personal baggage provided that the loading or unloading shall not extend beyond the time necessary therefor.

(4)

The term "taxis only" means no stopping, standing or parking during any times or days posted for any vehicle other than a taxicab licensed for business by the Town. No owner or driver of any taxicab shall park or stand upon any street in the Town for any period of time longer than is necessary to discharge or receive passengers then occupying or then waiting for such taxicab.

When the Public Works Director, as authorized under this section, has caused signs to be placed, no person shall stop, stand or park a vehicle adjacent to any such legible signs in violation of any of the provisions of this section.

10.16.130. - Parking regulations—Unauthorized signs, curb, or street markings.

It shall be unlawful for any person to apply to a curb or street, or adjacent to any street, any signs, paint, or markings which shall tend to mislead operators of vehicles into believing that the same is an official traffic parking, loading zone, no parking area, or private parking area.

10.16.140. - Vehicle size limitations.

Vehicles parked at the Mammoth Yosemite Airport parking lot, not including the long-term parking lot, shall not include trailers and shall not exceed 20 feet in length unless the Town Manager, Public Works Director, or Airport Manager or his/her designee approves it.

10.16.150. - Winter parking on town roads—Winter parking prohibition.

(a)

The parking or standing of vehicles in designated areas on the roadside of the snow stakes along any Town road from November 1 through April 30 is prohibited unless the location has been designated for winter parking as specified herein.

(b)

The Public Works Director shall determine the days, times, and portions of Town streets upon which winter parking shall be permitted. Following the resolution of the Town Council approving such permission, the Public Works Director is authorized to place pavement markings or signs within or adjacent to such portions of Town streets in which winter parking shall be permitted. Winter parking, in accordance with the designation placed by the Public Works Director, shall be permitted during the days and times indicated and within the areas so designated.

10.16.160. - Winter parking on town roads—Obstructing snow removal.

It shall be unlawful for any person to park, abandon, or otherwise leave unattended any vehicle as defined in Vehicle Code § 670 on any Town right-of-way at any time or in any manner which will obstruct, hinder, delay or otherwise inconvenience any Town officer, employee or Town contractor during snow removal operations or which will leave the vehicle in such a position that it is subject to damage by Town officers, employees or Town contractors engaged in snow removal operations.

10.16.170. - Winter parking on town roads—Towing of parked vehicles.

(a)

Any member of the California Highway Patrol and any designated employee of the Police Department of the Town, may remove any vehicle parked or left standing upon any Town road in violation of this article

during the period of November 1 through April 30 of any year.

(b)

Vehicles so towed away pursuant to the ordinance codified in this chapter shall be removed to the nearest facility for the storage and safekeeping of vehicles.

10.16.180. - Winter parking on town roads—Preferential parking areas.

Preferential parking areas may be established by resolution of the Town Council and are effective only when properly signed.

10.16.200. - Overnight parking—Removal.

In the event any vehicle is stopped, parked, abandoned or left unattended in violation of the provisions of this article, any police officer or person authorized to remove or cause to be removed any such vehicle and to have such vehicle towed or otherwise removed to any public or private garage or parking area and to have such vehicle stored in such garage or parking area until claimed by the owner thereof.

10.16.210. - Overnight parking at Mammoth Yosemite Airport.

(a)

No person shall park or leave standing any vehicle at the Mammoth Yosemite Airport between the hours of 8:00 p.m. and 8:00 a.m., unless such vehicle is parked in an area designated for overnight parking and displays the required parking permit for such parking for airport users.

(b)

No person shall leave a permitted vehicle in the area designated for overnight parking for longer than seven consecutive nights. The Town Manager, Airport Manager, or his/her designee may allow longer periods of time if they deem it to be an extenuating circumstance and approve it beforehand.

(c)

Any person who fails to display a parking permit required for overnight parking shall be cited or towed and liable to the Town for such fees.

(d)

Citation charges may be collected by the Town Manager or his/her designee, the Mammoth Lakes Police Department, or the Airport Manager or his/her designee, by any means available for the collection of citation charges. Such enforcement may include the issuance of parking tickets and the use of administrative collection processes as are available under State law.
