3.46.010 - Chapter application.

This chapter shall apply to the levy of new fees or to the increase of existing fees, pursuant to the provision of Section 54985, et seq., of the Government Code of the state of California.

3.46.020 - Imposition—Rates.

There is imposed a new fee or an increase in existing fees as provided in the following subsections:

The county of Madera Revenue Services Division shall charge a thirty dollar administrative fee (thirty-five dollars on installment payment accounts) on all accounts received by the division for collection from other county of Madera departments. The division shall collect interest at the legal rate of interest on such accounts. Provided, however, this subsection shall not apply to Madera County court accounts.

3.46.030 - Charge for preparation and giving of notice, delinquent taxes.

The charge for preparation and giving notice of delinquency on each separate valuation on the secured roll of real property (except possessory interests), possessory interests, and personal property cross-secured to real property shall be twenty dollars ($20.00). The charge shall be collected even though the property appears on the roll due to a special assessment and no valuation of the property is given.

3.46.040 - Fee schedule for services provided by the department of technology.

A. The board finds that the department's general hourly rate for services provided to other departments and agencies of the county of Madera is fifty dollars per hour, and which generated actual revenue of nineteen thousand seven hundred sixty-one dollars in fiscal year 2007-2008. The board further finds that increased fees are necessary because the existing general hourly rate does not reflect the true costs and staff time involved in providing services to county departments, which have increased significantly since the fees were initially enacted in 1998. The board bases its findings on the letter of director of information technology, Robert Connal, which is attached collectively as exhibit "A" and incorporated by reference. The board further finds that an automatic adjustment of some of the department's fees shall be included, based on the Consumer Price Index, which provides the best estimate of the average change in the price of goods and services over time. The board bases its findings on an analysis of the Consumer Price Index prepared by the resource management agency and submitted to the board on October 5, 2004, a copy of which is attached as Exhibit "B" and incorporated by reference.

B. The general hourly rate for services provided by the department of information technology, including responses to requests made under the California Public Records Act (Government Code section 6250 et seq.) for production of documents and recordings in electronic form, shall be eighty-nine dollars and twenty-three cents per hour.

C. The general hourly rate for services provided by the department of information technology shall be subject to an automatic annual rate revision based on the Consumer Price Index for All Urban Consumers ("CPI"), as published by the U.S. Bureau of Labor Standards, beginning July 1, 2010 and occurring every July 1 thereafter, not to exceed four percent per year.

3.46.050 - Fee schedule for services provided by the office of the treasurer-tax collector.

A. The board of supervisors finds that the treasurer-tax collector conducts an analysis of proposed fees based on current legislation governed by the State of California for the actual costs incurred to perform services according to law. The board of supervisors finds that the charges in this section are intended to reflect and recover and not exceed the cost and time spent by county employees to provide the listed services and documents and are similar to charges found in other counties for similar services.

B. The fees charged and collected by the office of the treasurer-tax collector, not otherwise set by other enactments, shall be as follows:

A. The Board of Supervisors finds that Treasurer-Tax Collector staff have conducted a fee analysis to determine the actual costs incurred to perform services according to State Law. Based upon staffs fee analysis, the Board or Supervisors finds that the fees in the schedule identified in this Section do not exceed the reasonable costs to the County of providing the identified services.

B. The fees charged and collected by the office of the Treasurer-Tax Collector, not otherwise set by other enactments, shall be as follows:

C. All fees listed herein may be adjusted annually by the Board or Supervisors based on the Consumer Price Index for All Urban Consumers ("CPI"), as published by the U.S. Bureau of Labor standards, occurring every July 1 thereafter, not to exceed four percent per year. The Treasurer-Tax Collector shall make available to the Board of Supervisors annually a fee schedule for each year which shall specify whether the CPI factor is applied to the fees for the year.
