Chapter 13.06 — WATER APPEALS BOARD/WATER ADVISORY COMMISSION

Editor's note— The chapter title was amended by Ord. 383D.  Ord. No. 383G, § 1, repealed Sections 13.06.070—13.06.170, which pertained to water advisory commission established; membership— appointment; term of office; vacancies—removal from office; officers; meetings; expenses; duties; board of supervisors/directors; elimination of water and flood control committees; and limitations, respectively and derived from Ord. No. 383D, 2007 and Ord. No. 383E § 1, adopted December 16, 2008.

13.06.010 - Established—Membership.

There is hereby established in the county a board to be called the "water appeals board" consisting of the five members of the board of supervisors, who shall be the voting members. Three affirmative votes shall be required in modifying any order given pursuant thereto, in revoking any registration or authorization, or in any quasi-judicial decision. There shall be five advisory members who shall have no vote: The county engineer, the director of planning, the director of public health, the road commissioner and the county counsel.

13.06.020 - Meetings and records.

Minutes of all proceedings shall be kept by the water appeals board showing the voting records of the members and other official actions. Such minutes shall be public records.

13.06.030 - Appeals.

Any person may appeal in writing, within fifteen days, to the water appeals board from any decision of the administrative staff pertaining to the provisions of this article. Such written appeal shall contain all factual information supported by a registered civil engineer's report when technical and engineering questions are involved.

13.06.040 - Notice of hearing.

Upon receiving a notice of appeal, the water appeals board shall set the matter for public hearing and give not less than five days' notice in writing to the appellant of the time and place of such hearing as provided in Section 13.09.050.

13.06.050 - Decisions.

The water appeals board may affirm, reverse, or modify the determination of the administrative staff, but such decision shall be in writing, and shall specify the reasons for its decision and contain specific directives to the administrative staff for the carrying out of such decision.

The decision of the water appeals board shall be final.
