10.08.010 General

A. Purpose and Intent

It is the purpose and intent of this chapter to establish standards for the establishment and operation of mobilehome parks to provide occupants of mobilehomes with a suitable living 10.04.200 (Continued) – 10.08.010

environment. It is based upon the promise that the use of mobilehomes for residential purposes constitutes essentially a residential use of property and is adopted to promote the general health, safety and welfare of occupants of mobilehomes.

B. Definitions

Mobilehomes or trailers: Any camp-car, trailer, trailer-coach, or other vehicle with or without motive power constructed or used for human habitation.

C. Mobilehome Park

Any area or tract of land where two or more mobilehome lots are rented or leased or held out for rent or lease to accommodate mobilehomes used for human habitation. The rental paid for any such mobilehome shall be deemed to include rental for the lot it occupies.

10.08.020 Mobilehome Park Standards

A. Landscaping

  1. Fencing: Fencing enclosing park shall be installed within five years. Fencing shall be at a minimum height of six feet.
  2. All areas not improved shall be surfaced with lawn, bark, gravel, or other surface to restrict dust.
  3. Parking: Provisions shall be made for off-street parking of two automobiles per site.
  4. Streets shall be sixty feet wide with gravel or better surface.
  5. Trees and shrubbery shall be planted to beautify the park.

B. Grading and Drainage

Park property shall be adequately graded and drained so as to prevent the accumulation of water within the park.

10.08.030 Mobilehome Parks & Mobilehomes on Sites

A. Location of Mobilehomes and Parks on Sites

There shall be no mobilehome parks or mobilehomes on either side of North First Street from the City limits sign on the east to Smithneck Creek Bridge on the west extending north and south for a distance of one block in either direction.

B. Site Size

The minimum site size in each park shall be 2400 sq. ft. No more than seventy-five percent (75%) of a mobilehome site shall be covered by mobilehome, buildings or other structures and at least 300 sq. ft. of a site shall be free of all structures and coverage.

10.08.040 Health and Safety Standards

A. Plumbing and Electrical

Plumbing and electrical installing shall be in accordance with the requirements of California Health & Safety Code. All utility lines shall be underground.

B. Garbage and Waste

Areas for garbage and waste material shall be provided. Garbage cans with tight lids shall be provided for each site.

C. Laundry Facilities

Refer to State Health and Safety Code.

10.08.050 Permits, Plans, and Licenses

A. Application to Construct A Mobilehome Park or Operate An Existing One

Every applicant for a permit to construct, establish, and maintain a mobilehome park shall file a written application with the Planning Commission of the City. A permit for construction of mobilehome parks shall be issued only with approval of the City Planning Commission. A detailed plot map shall accompany each application. Application form and map information shall be available at the City Hall. A permit to operate shall be required for all existing mobilehome parks and mobilehomes on rental property in accordance with the requirements of the California Health and Safety Code, Division 13, Part 2 and 2.1.

10.08.060 Fees & Permits

Fees as provided for the construction of a mobilehome park shall be charged as contained in the Health & Safety Code.

A. Filing of Application

Upon completion of a mobilehome park pursuant to the permit to construct, the owner, operator or person intending to operate the same shall file an application to operate with the City at the City Hall on the form prescribed by the City.

B. City Building Inspector to Inspect

Upon receipt of said application, the City shall refer it to the City Building Inspector who shall inspect said park to determine if all of the improvements required to be made under the permit to construct have been constructed and installed; and that the park conforms to all of the requirements of the Health & Safety Code and of this chapter; and upon approval thereof by the City Building Inspector, the City shall thereupon issue a permit to operate.

C. Permit Term

The permit to operate shall be for the term of one year and shall be renewed thereafter upon application and payment of the required fee. Permits to operate may be denied if at time of renewal the park is in violation of the chapter or of the Health & Safety Code, and if the owner has been notified.

10.08.070 Variance, Appeals, Enforcements & Violations

A. It shall be unlawful for any person or persons to camp, park or locate any occupied mobilehome or trailer-coach within the City of Loyalton, except within a Licensed mobilehome park or area designated as a camping park.

B. Effect of Chapter on Existing Mobilehome and Mobilehome Park Mobilehomes and Mobilehome parks existing upon the effective date of this chapter shall not be deemed to be governed by the requirements of this chapter, except as to those provisions requiring a permit to operate and the fees required. Such existing mobilehome park shall be governed by the provisions of part 2.1, division 13, of the Health & Safety Code of the State of California, and any and all rules and regulations as may have been adopted pursuant thereto.

C. Any occupants of mobilehomes who vacate or move a mobilehome from its existing site on any city lot shall not reoccupy that mobilehome or move another mobilehome onto that site.

D. Any request for variance may be submitted to the Loyalton Planning Commission.

E. Any person aggrieved by any order or decision may appeal to the Loyalton Planning Commission by filing a written notice of appeal at the City Hall. The City Council shall set the appeal for public hearing and give notice thereof by publication at least ten (10) days before the date set for the hearing.
The Council shall hear and consider all evidence submitted by the appellant and shall determine whether the decision appealed from shall be sustained, overruled, or modified.
