13.200.010 - Military Equipment Use.

A.

Pursuant to Government Code section 7071, this Board approves and adopts the Sheriff's AB 481 Military Equipment Use Policy, reviewed by the Board and located on the Sheriff's public website (https://lasd.org/transparency/ab481/). The Military

Equipment Use Policy has been publicly available on the Sheriffs website for at least 30 days prior to public hearing concerning the military equipment at issue.

B.

The Board of Supervisors finds and declares as follows:

The equipment listed in the Sheriffs Military Equipment Use Policy is necessary because there is no reasonable alternative that can achieve the same objective of officer and civilian safety.

The Sheriff's Military Equipment Use Policy will safeguard the public's welfare, safety, civil rights, and civil liberties.

Purchase of the equipment listed in the Sheriffs Military Equipment Use Policy will be reasonably cost effective compared to available alternatives that can achieve the same objective of officer and civilian safety.

The Sheriff has taken action to remedy any nonconforming uses and ensure that any future use of military equipment will comply with the Military Equipment Use Policy.

The Sheriffs Military Equipment Use Policy shall be made publicly available on the Sheriffs website for as long as the military equipment is available for use or as otherwise ordained by the Board.

C.

The Sheriff shall submit an annual military equipment report to the Board containing the information required by Government Code section 7072 and the Board shall thereafter determine whether each type of military equipment identified therein has complied with the standards for approval set forth in Government Code section 7071 (d).

D.

The Board shall on an annual basis and at a regular meeting thereof review this Chapter and vote on whether to renew pursuant to Government Code section 7071 (e).

E.

The definitions set forth in Government Code section 7070 shall apply to this Chapter. Any provision of state law referred to herein shall mean and include any amended or successor provision thereof.
