13.28.010 - Deposits for subdivided land.

The developer may elect to convey, with the approval of the city engineer, the stormwater which reaches and flows from his or her development to a channel designated by the city engineer as a major watercourse. If the stormwater is not so conveyed, the developer shall, in lieu thereof, pay a storm drainage fee of one and one-half cents per square foot of the gross area of the subdivision, including streets. The amount of the fee shall be recorded as a credit, apportioned to the lots of the entire subdivision and applied to this extent against any assessment or charge of such lots in any future drainage assessment proceeding which includes such property.

13.28.020 - Deposits for subdivided land nonrefundable—Waivers.

The sum provided for in Section 13.28.010 of this chapter has been determined by experience as compensatory in a reasonable degree for the drainage expense created by such development and shall be nonrefundable. Such deposit may be waived if the city engineer certifies that satisfactory drainage

provisions have been made for delivering and discharging the surplus water from such area into a channel designated by the city engineer as a major watercourse.

13.28.030 - Deposits for commercial structures.

As a condition to the approval of any plans or issuance of a permit for any structure for commercial development which shall reduce the absorptive area of any property within the city, there shall be required a deposit of three cents per square foot of lot area, subject to the exceptions provided in this chapter. "Commercial development" shall mean any development other than single-family residences in an R-1 Zone.

13.28.040 - Drainage deposit fund.

The sums deposited as required by this chapter shall be placed in a special drainage deposit fund to be expended therefrom by the council upon its finding that benefit in fact accrues therefrom to the property from which a deposit has been made. Such finding shall only be made upon advice as to the fact of benefit by the city engineer.
