§ 9.05.010. Authority.

Section 35701 of the California State Vehicle Code authorizes city governments to regulate the use of a street by any commercial vehicle or by any vehicle exceeding a maximum gross weight limit.

§ 9.05.020. Findings.

The town council finds and determines that the regulation of commercial vehicles as provided for herein is necessary for the public health safety and the protection of public and private property.

§ 9.05.030. Definitions.

For the purpose of this chapter, the phrase "commercial vehicle" shall have the meaning set forth in Section 260 of the Vehicle Code.

§ 9.05.040. Limitation of trucks on King Road.

No commercial vehicle in excess of ten thousand pounds maximum gross weight shall be permitted on King Road from Swetzer Road to Sierra College Boulevard.

§ 9.05.050. Provisions inapplicable to certain vehicles.

A. The provisions of this chapter shall not apply to any commercial vehicles coming from an unrestricted street having ingress and egress by direct route to and from King Road when necessary for the purpose of making pickups or deliveries of goods, wares and merchandise from or to any building or structure located on the restricted street or for the purpose of delivering materials to be used in the actual and bona fide repair, alteration, remodeling or construction of any building or structure upon King Road for which a building permit has previously been obtained.

B. This chapter shall also not apply to any vehicle owned by a public utility or a licensed contractor while necessarily in use in the constructing, installation or repair of any utility.

§ 9.05.060. Violation—Penalty.

It is unlawful to violate any section of this chapter and such violation is a misdemeanor as defined in the California State Penal Code.

§ 9.05.070. Effective date of chapter.

The ordinance codified in this chapter shall take effect thirty days from and after its final passage and after it has first been approved by the department of transportation and until King Road and any other road deemed appropriate are posted with appropriate signs notifying the public of the restrictions imposed by this chapter.
