20.36.010 - Purpose.

The purpose of this chapter is to establish a fuel flowage fee on aviation fuel delivered to commercial fuelers and self-fuelers at Lincoln Municipal Airport. Said fees are established in order to provide revenues for the operation of said airport and as a reasonable means of securing compensation for the privilege of conducting aircraft fueling activity by general aviation fixed-base operators or aircraft owners or operators at said airport.

20.36.015 - Definitions.

"Airport" means the Lincoln Municipal Airport.

"Aviation fuel" means any fuel intended for use in an aircraft, including, but not limited to, aviation gas, jet fuel and motor vehicle grade fuels.

"Commercial fueler" means any person, firm or corporation engaged in the retailing or delivery of aviation fuel at Lincoln Municipal Airport to other users at said airport.

"Self-fueler" means any person, firm or corporation owning or operating an aircraft and who self-fuels said aircraft at Lincoln Municipal Airport.

20.36.020 - Fuel flowage fees for commercial fueling.

Any commercial fueler shall pay to the city of Lincoln a fuel flowage fee in the amount of $0.11 for each gallon of aviation fuel received during a calendar month by said commercial fueler at its fueling facility at the airport. The city council may set by resolution the flowage fee.

20.36.030 - Fuel flowage fees for self-fueling.

Any self-fueler shall pay to the city a fuel flowage fee in the amount of $0.11 for each gallon of aviation fuel received during a calendar month by said self-fueler at its fueling facility at the airport. The city council may set by resolution the flowage fee.

20.36.040 - Reports and fee and interest payment.

Every commercial fueler or self-fueler shall submit monthly activity reports to the director of the city concerning fueling activity at the airport in such form and detail, and at such time or times, as the director may prescribe. The fuel flowage fee shall be paid by the fuelers by the tenth day of each calendar month for the previous month's fuel deliveries. Any payment not received within seven days after the due date shall accrue interest at the rate of one and one-half percent per month from the due date until paid in full.

20.36.050 - Permits.

No person, firm or corporation shall conduct either commercial fueling or self-fueling of aircraft at the Lincoln Municipal Airport without obtaining a permit issued by the director. The director is authorized to issue revocable permits for such commercial fueling and/or self-fueling. The city council may determine by resolution what fee, if any, shall be charged for the issuance of permits under this section. The director shall determine what amount of insurance shall be required to be carried by the fuelers. The director is further authorized to include provisions in the permits protecting the city and the public health, safety and welfare in the conduct of fueling activities on the airport, including safety and service requirements and compliance with the provisions of this title.

20.36.060 - Discounts.

The director is authorized to set up discount policies and special sales to encourage use of the airport and increase fuel sales.
