§ 2.40.510. Board created.

There is created a personnel board to consist of five members.

§ 2.40.520. Qualifications.

No person shall be appointed to the board who holds any elected office with the city; has been appointed by the city council and holds a position on any other board, commission or committee of the city; or who is employed by the city. The city council shall endeavor to appoint qualified professional persons with education, training, and experience in the field of labor management, personnel relations and employee discipline.

§ 2.40.530. Term of office.

Board members shall serve for a two-year term, unless earlier terminated as provided in this chapter. All terms of office shall commence on March 1st of each odd-numbered year and expire on February 28th of the succeeding odd-numbered year, except as otherwise provided in this chapter.

§ 2.40.540. Powers and duties.

A. The personnel board shall have the right of subpoena, the power to examine witnesses under oath, the power to compel the attendance of witnesses and the power to require the production of evidence by subpoena. Subpoenas shall be issued in the name of the city and attested by the city clerk.

B. Each member of the board shall have the power to administer oaths to witnesses.

C. The board, in a manner provided for in the rules and regulations of the classified service, shall hear appeals submitted by any person in the classified service relative to any disciplinary action, dismissal, demotion, charge of discrimination or alleged violation of this chapter or the rules and regulations of the classified service; and shall certify its findings and recommendations as provided in the rules and regulations of the classified service.

§ 2.40.550. Rules of procedure, selection of chairperson.

The personnel board shall adopt rules of procedure and shall select a chairperson from among its members who shall act as presiding officer.

§ 2.40.560. Conduct of business.

The personnel board shall determine the order of business for the conduct of its meetings and shall meet on call of the chairperson or the personnel officer.
