Chapter 17.16 — CHANGE OF ZONE

§ 17.16.010. Statutory authority.

All changes of zone shall be made pursuant to the California Government Code or other applicable state law.

§ 17.16.020. Initiation procedure.

A change of zone may be initiated by the city council, or by the commission or pursuant to a petition filed as provided in Chapter 17.12 . (Prior code § 2-3-2)

§ 17.16.030. Fee—Application.

  • A. Upon paying the filing fee and making the deposit as required by Section 17.12.040 , any person may file with the director an application for change of zone.

  • B. In an application for a change of zone the applicant shall show:

    1. When existing zoning was effective and whether there are changed conditions to warrant other or additional zoning;
  1. Whether proposed change of zone will adversely affect the adjoining property as to value, precedent, or be detrimental to the area;

  2. Whether change of zone will be in the interest of furtherance of public health, safety and general welfare; and

  3. Such other information as the commission deems necessary. (Prior code § 2-3-3)

§ 17.16.040. Hearing not required.

An application for change of zone shall be construed as a suggestion only. The commission is not required to hold any public hearings merely because an application for change of zone has been filed.
