§ 17.44.010. Commercial districts—Purposes and application.

The commercial districts included in this code are designed to provide the opportunity for various types of retail stores, offices, entertainment and restaurant facilities, commercial recreation, service establishments and wholesale business to concentrate for the convenience of the public; to be established in such relationships to each other as to be mutually beneficial; and to be located and grouped on sites that are in logical proximity to the respective geographical areas and categories of patrons which they serve.

§ 17.44.020. CN: neighborhood commercial district.

  • A. Application. The neighborhood commercial district is intended primarily for the provision of retail and personal service facilities to satisfy the convenience needs of the consumer relatively close to the consumer's place of residence.

  • B. Permitted Uses. Retail stores, offices and service establishments which supply goods or provide services primarily to meet the convenience of residents of one or more residential neighborhoods shall be permitted, including the following:

  • C. Permitted Uses. Administrative Approval Required. The following uses may be permitted in accordance with the provisions of Chapter 17.108 :

    1. City, county, state and federal administrative offices, libraries, and police and fire stations;

    2. One-family dwellings over or to the rear of a permitted use; provided, such dwellings shall be subject to the use, site area, coverage and yard requirements of the RM-2 district;

  1. Electric transmission lines subject to the provisions of Section 17.108.080 , electric transmission and distribution substations, gas regulator stations, communications equipment buildings, public service pumping stations, and/or elevated pressure tanks;

    1. Private clubs and lodges and drive-in restaurants;

    2. Public parks and playgrounds, public and quasi-public uses of an educational or religious type, including public and private elementary, junior and senior high schools, colleges, nursery schools, trade schools and private schools;

    3. Incidental and accessory structures and uses locates on the same site as a use permitted by administrative approval or conditional use;

    4. Other uses that are added to this list according to the procedure in Section 17.16.020 .

  • D. Conditional Uses—Commission Approval Required. The following conditional uses may be permitted in accordance with Chapter 17.112 :

    1. Bowling alleys;
  1. Assembly uses;

  2. A state authorized licensed day care center for 13 or more children;

  3. Restaurants and cafés, including the serving of alcoholic beverages when incidental to food service;

  4. Expansion or remodeling of an existing nonconforming use of a structure or land, limited to 50% or less of the value of existing structures, or reestablishment of a nonconforming use which has been damaged, except nonconforming signs and outdoor advertising structures, nonconforming uses occupying a structure with an assessed valuation of less than $200, and nonconforming fences, walls and hedges;

  5. Expansion, remodeling or additions to a conditional use that are not considered an incidental or accessory use as defined in Section 17.04.080 ;

  6. Service stations (gasoline), excluding automotive repair services not included in the definition of "service station" in this chapter; provided, all operations, except the sale of gasoline and oil, shall be conducted in a building enclosed on at least three sides;

§ 17.44.030. CC: central commercial district.

  • A. Application. The central commercial district serves as the primary commercial district of the community where a wide range of retail, financial, governmental, professional, business service and entertainment activities and uses are encouraged to concentrate to serve the entire community. Central commercial areas are intended to be developed only as unified commercial centers, except where the existing development pattern makes it impractical.

  • B. Permitted Uses.

    1. Any use listed as a permitted use in the CN district;

    2. Parking lots improved in conformity with the standards prescribed for required off-street parking facilities in Chapter 17.76 ;

    3. Professional and commercial offices;

    4. Retail stores and service establishments which supply commodities or provide services primarily to meet the needs of residents of the entire community, including the following:

  • C. Permitted Uses—Administrative Approval Required. The following uses may be permitted in accordance with the provisions of Chapter 17.108 :

    1. Electrical distribution substations, communication equipment buildings, gas regulator stations and utility pumping stations;

    2. Incidental and accessory structures and uses located on the same site as a use permitted by administrative approval, or conditional use;

    3. Other uses which are added to this list according to the procedure in Section 17.16.020 ;

    4. Temporary uses such as a circus, carnival, religious revival, Christmas tree lot, promotion and sale in trucks or trailers, animal show or display, and pumpkin patch pursuant to Section 17.108.080 .

  • D. Conditional Uses—Commission Approval Required. The following uses may be permitted in accordance with the provisions of Chapter 17.112 :

    1. Bars, cocktail lounges and nightclubs;

    2. Assembly uses;

    3. City, county, state or federal administrative offices, libraries, police and fire stations;

    4. Farmers markets, including indoor and outdoor facilities;

    5. Service commercial uses designated by an asterisk (*), as listed under Section 17.44.040 , which include incidental retail and/or office use;

    6. Expansion or remodeling of an existing nonconforming use of a structure or land, up to 50% or less of the value of the structure, or reestablishment of a nonconforming use which has

been damaged, except nonconforming signs and outdoor advertising structures, nonconforming uses occupying a structure with an assessed valuation of less than $200, and nonconforming fences, walls and hedges;

  1. Expansion, remodeling or additions to a conditional use that are not considered an incidental or accessory use as defined in Section 17.04.080 ;

  2. Incidental and accessory structures and uses located on the same site as a conditional use;

  3. Service stations, as defined by Section 17.04.080 of this code;

§ 17.44.040. CS: commercial service district.

  • A. Application. The service commercial district is intended primarily for establishments engaged in servicing equipment, materials and products, but which do not require the manufacturing, assembly, packaging or processing of articles or merchandise for distribution and retail sale. Land requirements for most service commercial uses generally dictate their application along arterial and collector streets of the city which generally lie close to central commercial, highway commercial and industrial districts, in accordance with the general plan.

  • B. Permitted Uses.

    1. Off-street parking lots improved in conformity with Chapter 17.76 shall be permitted;

    2. Service commercial establishments, including the following. (Note: Those uses marked with an asterisk (*) are permitted as conditional uses in CC districts, as indicated in Section 17.44.030 :

    2. Drive-in theaters, golf driving ranges, pony riding rings, race tracks, riding stables, skating rinks, sports arenas and sports stadiums, and other similar open, unenclosed commercial recreation facilities;

    3. Electroplating shops;

    4. Expansion or remodeling of an existing nonconforming use of a structure or land, up to 50% or less of the value of the structure, or reestablishment of a nonconforming use which has

been damaged, except nonconforming signs and outdoor advertising structures, nonconforming uses occupying a structure with an assessed valuation of less than $200, and nonconforming fences, walls and hedges;

  1. Public buildings and grounds;

  2. Assembly uses;

  3. Expansion, remodeling or additions to a conditional use that are not considered an incidental or accessory use;

  4. Other uses which are added to this list according to the procedure in Section 17.16.020 ;

  5. Excavations according to the requirements of Chapter 17.88 ;

  6. Service stations (gasoline), including dispensing of diesel fuel and complete truck service;

§ 17.44.050. CH: highway commercial district.

  • A. Application. The highway commercial district is intended primarily for application to areas along major highway entrances to the city in accord with policies of the general plan, where controlled access to the highway is afforded for the convenience of patrons traveling the highway by the provision of frontage roads, interchanges, channelized intersections and control over driveway spacing.

  • B. Permitted Uses.

    1. The following highway commercial uses are permitted:

    2. Overnight parking for recreational vehicles;

    3. Travel plaza or truck stop as defined by Section 17.04.080 ;

    4. Service stations as defined by Section 17.04.080 ;

    5. Expansion or remodeling of an existing nonconforming use of a structure or land, up to 50% or less of the value of the structure, or reestablishment of a nonconforming use which has been damaged, except nonconforming signs and outdoor advertising structures, nonconforming uses occupying a structure with an assessed valuation of less than $200, and nonconforming fences, walls and hedges;

    6. Expansion, remodeling or additions to a conditional use that are not considered an incidental or accessory use as defined in Section 17.04.080 ;

§ 17.44.070. Reserved.

§ 17.44.080. Required conditions for commercial districts.

  • A. In any C district other than a CS district, all businesses, services and processes shall be conducted entirely within a completely enclosed structure, except for off-street parking and offstreet loading areas, gasoline service stations, outdoor dining areas, nurseries, garden shops, signs, Christmas tree sales lots, bus depots and transit stations, public utility stations, and used car sales incidental to new car sales.

  • B. No use shall be permitted, and no process, equipment or materials shall be used which are found by the planning commission to be objectionable to persons living or working in the vicinity by reasons of odor, fumes, dust, smoke, cinders, dirt, refuse, water-carried waste, noise, vibration, illumination, glare or unsightliness or to involve any hazard of fire, explosion or toxic chemicals.

  • C. Temporary sidewalk sales and use of the public right-of-way for the display and sales of merchandise shall conform to the provisions of Chapter 8.25 . Permanent use for such purposes is strictly prohibited.

  • D. The visual interface between commercial and residential areas shall be designed and developed so as to avoid obtrusive visual impacts of commercial activities on nearby residential areas.

  • E. Street trees and frontage landscaping with automatic irrigation shall be provided for all commercial sites. Parking area landscaping may also be required under site plan review.

§ 17.44.090. Property development standards for commercial districts.

  • A. Screening and landscaping, fences, walls and hedges shall conform to the provisions of Chapter 17.92 .

  • B. Site Area. There shall be no limitation.

  • C. Frontage, Width and Depth. There shall be no limitation.

  • D. Coverage. There shall be no limitation.

  • E. Yard Requirements.

    1. The minimum front yard shall be as follows:

Note:

1 Minimum on a site abutting on property in an RCO, UR-ST, R, or RM District and fronting on the same street.

  1. Except as specified below, no side yards or rear yards shall be required;

    • a. In any commercial district, the minimum side yard abutting an RCO, UR-ST, R, or RM district shall be 10 feet.

    • b. In any commercial district, the minimum rear yard abutting an RCO, UR-ST, R, or RM district shall be 10 feet.

  • F. Distances Between Structures. The minimum distance between a dwelling unit and another structure shall be 10 feet.

  • G. Building Height. In a CN or CH district, 65 feet maximum; in a CC or CS district, 75 feet maximum, except as may be provided under the provisions of Section 17.52.010 , Chapter 17.56 or 17.112 .

  • H. Off-Street Parking and Off-Street Loading. Off-street parking and off-street loading facilities shall be provided as prescribed in Chapter 17.76 .

  • I. Signs and Outdoor Advertising Structures. No sign or outdoor advertising structure of any character shall be provided, except as prescribed in Chapter 17.84 .

§ 17.44.100. Site plan and architectural design review required.

No use shall be established on any lot or site in any C district until a site plan and architectural plans shall have been submitted to and approved by the city pursuant to the provisions of Chapters 17.100 and 17.104 of the Lathrop Municipal Code, and such lot or site has been fully developed with the improvements required by the city. Design review is required for all proposed structures, together with related site plans, landscaping, and public improvements associated with new development. (Ord. 92-73; Ord. 25-462, 2/10/2025)

§ 17.44.110. General provisions and exceptions.

All uses shall be subject to the general provisions and exceptions in Chapter 17.16 . (Ord. 92-73)

Chapter 17.46. OLD HARLAN ROAD COMMERCIAL OVERLAY DISTRICT

§ 17.46.010. Purpose and applications.

The Old Harlan Road commercial overlay district is intended for use on specific properties located in the central commercial (CC) district, which are shown on the map contained in Section 17.46.090 of this chapter. This district is intended:

  • A. To prevent deterioration and blight of commercially zoned properties;

  • B. To allow more flexibility and consideration of commercial uses and activities to meet the needs of residents and the entire community;

  • C. To allow commercial uses and activities in order to stay competitive with surrounding cities that may desire to accommodate many of these same uses;

  • D. To create opportunities to attract and retain businesses within the city of Lathrop. (Ord. 09-290 § 1)

§ 17.46.020. Permitted uses.

The specified properties in the Old Harlan Road commercial overlay district which are zoned CC central commercial shall include all uses permitted by Section 17.44.030B of this title and the following permitted uses:

  • A. Automobile glass (installation and repair);

  • B. Automobile smog shops (testing and repair);

  • C. Automobile sales (new and used);

  • D. Automobile service and repair shops (excluding body and fender work);

  • E. Automobile tire sales, service and repair shops;

  • F. Automobile upholstery and top shops;

  • G. Boat, motorcycle and motorsport sales and service (new and used);

  • H. Recreational vehicle and recreational trailer sales and service (new and used);

  • I. Carpeting and flooring;

  • J. Equipment rental;

§ 17.46.030. Permitted uses—Administrative approval required.

The specified properties in the Old Harlan Road commercial overlay district which are zoned CC central commercial shall include all uses permitted by Section 17.44.030C of this title, unless otherwise permitted by this chapter. (Ord. 09-290 § 1)
