5.16.460 - Definitions.

The following words and phrases, whenever used in this article, shall be construed as hereafter set forth, unless it is apparent from the text that such words and phrases have a different meaning:

"Basic service rates and charges" means the basic service tier rates and charges for related equipment, installation and services all as more fully set forth in the Federal Cable Television Consumer Protection and Competition Act of 1992.

"FCC Rate Regulations" means those regulations released May 3, 1993 by the FCC in the Report and Order, In the Matter of Implementation of Sections of Cable Television Consumer Protection and Competition Act of 1992: Rate Regulation, MM Docket 92-266, FCC 93-177 and all successor regulations thereto.

5.16.470 - Regulation of basic service rates and charges.

Grantor shall regulate basic service rates and charges of all grantees operating in the city pursuant to the Federal Cable Television Consumer Protection and Competition Act of 1992, as that Act may be amended. Grantor shall follow the FCC Rate Regulations in its regulation of the basic service rates and charges of any grantee and any other cable television system operating in the city, notwithstanding any different or inconsistent provisions in any franchise agreement.

5.16.480 - Rate regulations hearings.

In connection with the regulation of basic service rates and charges, grantor will provide a reasonable opportunity for consideration of the views of interested parties. The city manager, or his or her designee, shall provide for rate regulation hearings which are consistent with the FCC Rate Regulations.
