5.04.210 - Definition.¶
For the purpose of this chapter, a "peddler" or "vendor" is any person who travels from place to place within the city offering services, carrying, transporting or conveying goods, wares, merchandise of any kind, fruit, vegetables, drinks, or any foodstuffs or refreshments, displaying or offering the same for sale, taking orders for, or soliciting orders for goods, wares or merchandise for present or future delivery, or who, without traveling from place to place, sells or offers the same for sale from his person or from any wagon, pushcart, vehicle or other means of transportation or conveyance. The word "peddler" or "vendor" shall include the words "hawker," "huckster" and "street merchant."

5.04.220 - Posted premises.¶
No person shall engage in the sale of, taking orders or soliciting orders for goods, services, wares or merchandise as defined in Section 5.04.210 upon any premises without a prior invitation from the occupant thereof if such premises is posted against such solicitation by means of a notice prominently displayed on or near the main entrance to the premises or on or near any residence located thereon upon which is printed the legend: "NO SOLICITORS" (or words of similar import).

5.04.230 - Failure to leave premises.¶
No person shall engage in the acts specified in Section 5.04.210 upon any premises after having been asked by the owner or occupant thereof to leave such premises.

5.04.240 - Prohibited practices.¶
A. Other than upon prior initiation of the occupant, the activities defined in Section 5.04.210 shall be prohibited prior to nine a.m. and after six p.m.
B. At the time of initial contact with a prospective customer no person shall fail to verbally identify himself.
C. No person shall misrepresent his purpose or use any false, deceptive or misleading misrepresentation to induce the sale or use any plan, scheme or ruse which misrepresents the true status or mission of the person making the call.
D. No person shall engage in the act of peddling or vending on public property, within five hundred (500) feet of and abutting or adjacent to any elementary, junior high or high school on those days that school is in session during the hours of seven a.m. to five p.m. This prohibition shall not apply to anyone engaged in that act of vending or peddling at the request of the owner of public property, including schools, or agent of the owner, for the purpose of providing services to the owner, the owner's employees, tenants, contractors or others on their property with the consent of the owner. The prohibition shall also not apply to anyone engaged in the act of vending who has been granted specific written permission by the principal of the school to vend in an area designated by that principal. The school principal shall identify such areas that he or she determines to be safe for the purpose of vending to students and not potentially disruptive to the orderly operation of the school.
