Chapter 17.100 — (OS) OPEN SPACE DISTRICT

§ 17.100.010. Purpose. ¶
Certain areas of the City, which are not suited for residential or other intensive use for the reason that they may endanger the health, safety, and welfare of persons due to flooding, fire or erosion, and those areas designated to allow citizens to pursue recreational activities are classified herein as the Open Space District.

§ 17.100.020. Establishment. ¶
Land placed in the OS district shall include:
A. Land under public ownership, such as:
Public parks, playgrounds, golf courses, and wildlife preserves;
Drainage or flood control channels, creeks, rivers, lakes and floodplains; and
Freeways/expressways and rights-of-way;
B. Land under private ownership which would endanger the health, safety, and public welfare of the residents, to include:
Areas where terrain is too steep to build upon or where grading of the land may endanger public health and safety due to erosion by flooding;
Areas subject to flooding or inundation from stormwater;
Geologically unstable areas; and
Greenbelt areas which are formed by land development by either preserving the land as a natural area or replaning the land to provide increased enjoyment for the residents;
C. Buffer areas which separate industrial and commercial districts from residential districts, providing the consent of the owners is obtained;
D. Areas of outstanding cultural or historical value.

§ 17.100.030. Uses permitted. ¶
A. No building or land shall be used, and no building or structure shall be designed, erected, structurally altered or enlarged except for the following purposes:
Drainage channels, watercourses, spreading grounds, settling basins, freeways, parkways, and park drives;
Privately owned or public recreational areas, parks, playgrounds, wildlife preserves, and such buildings and structures as are related thereto, but permitting no commercial uses;
Agricultural uses provided an agreement between the City and the land owner can be made which will allow him to operate under the California Land Conservation Act;
Similar uses to those listed in this section which, in the opinion of the Planning Commission, would not be detrimental or incompatible with the intent and purpose, as set forth in this chapter.
B. Uses prohibited in this district are:
Residential uses;
Commercial uses other than those incidental to recreational uses permitted in this section;
Industrial uses.

§ 17.100.040. Building height. ¶
No building shall exceed 25 feet or no more than one story. (Code 1987 § 17.35.040; Ord. 772 § 17.35.040, 1986)
§ 17.100.050. Lot coverage. ¶
No structure shall be permitted except accessory buildings or those structures related to public park and recreational facilities. In no case shall buildings or structures exceed 30 percent of the total area in uses.
