Sec. 12-1. - Declaration.¶
1.1 It shall be unlawful for any minor under the age of eighteen (18) years to be in or…¶
road, park, square or any other public place, or place open to the public such as any cafe, restaurant, bowling alley, drive-in theater, or any place of amusement, between the hours of 11:00 p.m. and 5:00 a.m. of the following day.

Sec. 12-2. - Exceptions.¶
2.1 The above section shall not apply:¶
(a)
Where the said minor is accompanied by a parent, legal guardian or other adult person having the care and custody of said minor; or
(b)
Where the said minor is on an errand at the direction of the minor's parent or guardian or responsible adult, without detour or delay; or
(c)
Where the presence of said minor in the place or places is connected with or required by some legitimate business, trade, profession or occupation, by reason of employment, trade, profession or occupation, by reason of employment, inclusive of time necessary for going to and returning from such place of business at which said minor is in attendance; or
(d)
Where the said minor is attending an official school, religious or other adult supervised recreational activity sponsored by the county, a city, a civic organization or other similar entity that takes responsibility for the safety of the minor, or going to or returning home from such an activity, without detour or delay; or
(e)
Where the said minor is:
(1)
In a motor vehicle involved in intrastate or interstate travel; or
(2)
Engaged in employment, or going to or returning home from employment, without detour or delay; or
(3)
Involved in an emergency; or
(4)
On the sidewalk adjacent to the minor's residence, providing the minor is not otherwise violating the law; or
(5)
Exercising First Amendment rights protected by the United States Constitution, such as the free exercise of religion, freedom of speech and the right of assembly; or
(6)
Emancipated pursuant to law.

2.2 If any section, subsection, clause or phrase of this article is for any reason held…¶
such decision shall not affect the validity of the remaining portions of this article. The Board of Supervisors of the County of Lake declares it would have passed this article and each section, subsection, sentence, clause or phrase thereof irrespective of the fact that any one or more section, subsection, sentence, clause or phrase be declared unconstitutional.

3.1 Any minor violating the terms of this article is guilty of a misdemeanor, and may…¶

3.2 Any parent, guardian or other adult person having the lawful custody, permanent or…¶
minor person who suffers, permits, or lets, either wilfully or negligently, such minor person to violate the provisions of this article, is guilty of a misdemeanor, and shall be punished by imprisonment in the county jail for a term not to exceed ninety (90) days, or shall be fined in a sum not in excess of three hundred dollars ($300.00), or shall be both imprisoned and fined in accordance herewith.
