Article I — ITINERANT BUSINESS PERMITS

Sec. 11-1. - Purpose.¶
It is in the best interests of the people of the County of Lake that persons who sell merchandise from door to door or solicit orders or contributions be of good moral character to insure honest dealings and to provide sufficient identification to apprehend persons perpetrating fraudulent or dishonest acts upon the citizens of the County of Lake.

Sec. 11-2. - Definitions.¶
For the purposes of this article, the following words and phrases shall have the following meanings:
2.1 Itinerant Vendor is any person who has not established place of business in the…¶

Sec. 11-3. - Permit Required.¶
Except as otherwise provided in this article, it shall be unlawful for any itinerant vendor to engage in any of the activities set forth in Section 11-2.1 hereof in the unincorporated area of the County, whether for himself or as an agent or employee of another, without having procured a permit in accordance with this article.

Sec. 11-4. - Application.¶
4.1 Before any permit shall be issued, application must be made to the sheriff and the…¶
furnish his name, his permanent address, his temporary address, if different from his permanent address, and full and complete information regarding the goods, wares or merchandise which he intends to sell. The applicant shall furnish the sheriff with his complete physical description, which shall include age, height,
weight, color of hair and eyes. Applicant shall submit a 4″ x 5″ photograph of himself and fingerprints to the sheriff, which shall be forwarded to the C.I.I., I.D. Division, for search.

4.2 If, prior to the making of application, the applicant has been arrested, he shall…¶

4.3 If the applicant is other than self-employed, he shall show in his application the…¶

4.4 Each application shall be accompanied by a nonrefundable payment of fifteen dollars ($15.00).¶
Sec. 11-5. - Issuance of Permit.¶
5.1 Upon filing of a complete application for a permit, the sheriff shall verify all information submitted.¶
Within five (5) working days of such filing, the sheriff shall submit requests to other agencies as he deems necessary. Within 10 days of receipt of all information necessary to verify the contents of the application and all of the provisions of this article having been met, the sheriff shall issue the permit.

5.2 No permit shall be issued to any person who has been convicted of a crime of moral…¶

Sec. 11-6. - Form of Permit.¶
The Itinerant Business Permit issued by the sheriff pursuant to this article shall be substantially in the following form:

Sec. 11-7. - Permit Transfers.¶
No permit issued hereunder shall be transferable, and shall be used only by the person to whom it shall have been issued.

Sec. 11-8. - Additional Permits.¶
Every itinerant vendor issued a permit hereunder who uses in such vending a motor vehicle, horse-drawn vehicle, stand, table or handcart shall, in addition to a personal permit, procure from the sheriff a permit for each such vehicle, stand, table or handcart used by him, and shall pay a fee of $10.00 per year.

Sec. 11-9. - Permit Exhibited.¶
Every person who is issued a permit must keep the permit in his possession at all times and must, upon demand from a peace officer, exhibit such permit.

Sec. 11-10. - Suspension of Permit.¶
10.1 The sheriff is authorized to temporarily suspend the permit of any itinerant…¶
whenever it appears to him that the permittee shall have engaged in any acts involving moral turpitude.

Sec. 11-11. - Exemptions.¶
This article shall not apply to merchants having an established place of business in the County, nor to wholesalers or their representatives, employees or agents calling upon retail business houses; nor to farmers and/or ranchers of the County or their employees selling farm products produced by such farmers and/or ranchers.

Sec. 11-12. - Exclusions.¶
No itinerant vendor, who is engaged exclusively in soliciting orders as agent or representative of any person having its place or places of business outside the State of California, shall be required to pay a permit fee for a permit for itinerant vendor defined herein.

Sec. 11-13. - Penalties.¶
Any person who violates any of the above Sections of this article is guilty of a misdemeanor and upon conviction shall be punished by imprisonment in the Lake County Jail for a term not exceeding six (6) months, or by fine not exceeding Five Hundred Dollars ($500.00) or by both such fine and imprisonment. Each such person shall be deemed guilty of a separate offense for every day during any portion of which any violation of any section of this article is committed, continued or permitted and shall be punishable therefor as provided by this section.
