Sec. 7.02.010. - Obstructing sidewalks and highways.

Every person who willfully and maliciously obstructs the free movement of any person on any street, sidewalk, or other public place or on or in any place open to the public is guilty of a misdemeanor.

Sec. 7.02.020. - Trespass upon fenced, cultivated land.

It shall be unlawful for any person to enter upon or go upon the lands of another, under cultivation or enclosed by a fence, for any purpose whatever, without the consent in writing of the owner of said premises, or of the person or persons entitled to the use and occupancy thereof, except in the lawful performance of an official duty. Violation of this section shall be an infraction.

Sec. 7.02.030. - Damaging land of another.

It shall be and is hereby declared unlawful for any person, other than the owner or lessee of the hereinafter designated land or lands, to cut, hack, injure, destroy, move or remove any cane, reeds, sticks, grass, bamboo, trees, lumber, brush, weeds or vegetation of any kind or nature or printed, painted or written signs, or to dig, move or remove any sand, gravel, rocks, dirt, soil, debris or other material or substance, or to start, build or maintain fires of any nature whatsoever in or on creeks, canals, channels or rivers or the banks, beds, levees, dikes or embankments of said creeks, canals, channels or rivers or other land or lands of another without the written consent of the owner or lessee of said creeks, canals, channels or rivers, or the banks, beds, levees, dikes or embankments of said creeks, canals, channels or rivers or other land or lands, or except in the lawful performance of an official duty. This section shall not prevent the abatement of nuisances or unsightly or unhealthful conditions by the City or persons acting under contract to the City or by property owners associations pursuant to rules, covenants and regulations.

Sec. 7.02.040. - Public nudity.

(a) The City Council finds and determines as follows:

(1) It is the policy of this City that the public beaches, parks and places hereof shall be available for the use and enjoyment of the public to the maximum extent possible.

(2) It is further the policy of this City that members of the public are entitled to use the public beaches, parks and places hereof without being subjected to offensive conduct by other members of the public.

(3) The presence of persons who are nude and exposed to public view in or on public rights-of-way, public parks, public beaches or any other public land, or in or on any private property open to public view from any public right-of-way, public beach, public park or other public land, tends to discourage the use and enjoyment of the public beaches, parks and places of this City, creates a nuisance, and is offensive to members of the public who wish to use and enjoy said public beaches, parks and places, and who are unwillingly exposed to such persons.

(4) The prohibition of nude persons from public places, places open to the public, and places open to public view is necessary to preserve and maintain the public order and the general welfare of the citizens of this City.

(5) It is the intent of this Council to prohibit nudity in public places, places open to the public, and places open to public view even when such nudity is not sexually motivated or otherwise lewd.

(b) The following words, terms and phrases, when used in this section, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

(05) Nude shall mean devoid of an opaque covering over any one of the following parts of the human anatomy: The genitals, pubic hair, buttocks, natal cleft, perineum, anal region, pubic hair region, or any portion of the female breast below the top of the areola thereof.

(10) Public right-of-way shall mean any place of any nature which is dedicated to use by the public for pedestrian and vehicular travel, and includes, but is not limited to, a street, sidewalk, curb, gutter, crossing, intersection, parkway, highway, alley, lane, mall, court, way, avenue, boulevard, road, roadway, viaduct, subway, tunnel, bridge, thoroughfare, square, and any other similar public way or place.

(1) Every person over the age of ten years is guilty of a misdemeanor who is nude and exposed to public view in or on any public right-of-way, public park, public beach or waters adjacent thereto, or other public land, or in or on any private property open to public view from any public right-of-way, public beach, public park, or other public land.

(2) The provisions of this section shall not apply to any acts which take place wholly within a fully enclosed building or any portion thereof; and nothing contained herein shall be construed to prohibit any act or acts which are expressly authorized or not prohibited by the Penal Code.

(3) The provisions of this section shall not apply to a theater, concert hall or similar establishment which is primarily devoted to theatrical performances.

Sec. 7.02.050. - Contents of newsracks.

The following words, terms and phrases, when used in this section, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

(05) Newsrack means any self-service or coin operated box, container, storage unit or other dispenser installed, used or maintained for the display and sale of newspapers or news periodicals.

(10) Parkway means that area between the sidewalks and the curb of any street, and where there is no sidewalk that area between the edge of the roadway and the property line adjacent thereto. Parkway also includes any area within a roadway which is not open to vehicular travel.

(15) Roadway means that portion of a street improved, designed or ordinarily used for vehicular travel.

(20) Sidewalk means any surface provided for the exclusive use of pedestrians.

(25) Street means all that area dedicated to public use for public street purposes and includes, but is not limited to, roadways, parkways, alleys and sidewalks.

(1) No person shall sell, offer for sale, or keep or maintain any newspaper or news periodical in any newsrack on any sidewalk in such manner as to expose to the public view any photograph, cartoon or drawing, contained within such publication, displaying any obscene matter, as such term is defined in Penal Code § 311(a), or any of the following:

a. The genitals, pubic hair, buttocks, natal cleft, perineum, anal region or pubic hair region of any person other than a child under the age of puberty;

b. Any portion of the breast, at or below the areola thereof, of any female person, other than a child under the age of puberty.

Sec. 7.02.060. - False reports or writings.

Whoever, in any manner within the jurisdiction of any office or department or agency of the City or State of California, knowingly falsifies, conceals, withholds or suppresses by any trick, scheme, verbal statement, writing or device, any fact, or makes any false, fictitious or fraudulent statement or representation, or makes or uses or causes to be made or used any false writing or document when he knows the same to contain any false, fictitious or fraudulent statement or entry is guilty of a misdemeanor.
