Sec. 5.14.010. - Leash required; restraint of dogs.

No person owning or having charge, care, custody, or control of any dog shall cause or allow, either willfully or through failure to exercise due care or control, any such dog to be upon any private property unless such dog is restrained thereon by a fence, wall, substantial chain, leash not exceeding six feet in length, other appropriate physical restraint, or is under the charge of a person competent to exercise care, custody, and control over such dog. No person owning or having charge, care, custody, or control of any dog shall cause or allow, either willfully or through failure to exercise due care or control, any such dog to be upon any highway, street, alley or any other public property unless such dog be restrained by a substantial chain, or leash not exceeding six feet in length, and is under the charge of a person competent to exercise care, custody and control over such dog, unless the owner or operator of such public property grants written permission for such dog to be on such property without such chain or leash.

Sec. 5.14.020. - Trespassing.

No person owning or having charge, care or custody of any animal shall permit such animal to trespass or be upon any private property of another person without the consent of such person.

Sec. 5.14.030. - Property damage.

No person owning or having charge, care or custody of any animal shall permit such animal to damage or destroy public property or the property of any person other than that of the owner of such animal.

Sec. 5.14.040. - Female dogs during breeding period.

During the breeding period, female dogs shall be confined in a building or secure enclosure in such a manner that they cannot come into contact with other animals, except for planned breeding.

Sec. 5.14.050. - Running on owner's premises.

The provisions of this chapter do not prohibit dogs from running at large on the premises of the owner or person having charge of such dog, nor do they prohibit dogs, other than unspayed female dogs during the breeding period, from running at large on any property with permission of the owner of such property.

Sec. 5.14.060. - Working dogs.

A working dog, performing acts such as herding, under the control and supervision of owner or handler, shall not be considered as unleashed while performing his duties. A hunting, obedience, tracking or show dog shall not be considered unleashed while performing in the above capacities.

Sec. 5.14.070. - Wild animals to be confined.

No person owning or having charge, care or custody of any feral animal, or operating any wild animal establishment, shall fail, refuse or neglect to keep all wild or feral animals under proper confinement on the premises, or cause, permit, suffer or allow any wild animal to be or run at large, nor shall any such person maintain any wild or feral animal on or within any premises in such manner as to endanger the life or limb of any person lawfully entering such premises.

Sec. 5.14.080. - Tying animals to trees, public poles and benches.

No person shall tie any animal to any shrub or tree growing along any public sidewalk or street or in any park of the City, or tie any unattended animal to any public poles, parking meters, fences, or benches.

Sec. 5.14.090. - Animal noises prohibited.

It shall be unlawful for any person to keep, maintain or permit, on any lot, parcel of land or premises under his control, any animal which, by any persistent sound or cry, disturbs the peace and comfort of the inhabitants of the neighborhood or interferes with the reasonable and comfortable enjoyment of life or property.

Sec. 5.14.100. - Excreta nuisance prohibited.

(a) It is unlawful for the owner or person having charge, custody or control of any animal to fail to immediately remove and dispose of in a sanitary manner, by placing in a closed or sealed container and depositing in a trash receptacle, any feces deposited by such animal upon public or private property, without the consent of the public or private owner or person in lawful possession of the property, other than property owned or controlled by the owner or person having custody of such animal.

(b) Any person who has charge, custody or control of an animal in a location other than on the property of such person or the property of the owner of the animal, shall have in possession a suitable wrapper, bag or container (other than articles of clothing) for the purpose of complying with the requirements of this section.

(c) The provisions of this section shall not apply to unsighted persons being accompanied by a guide dog.

Sec. 5.14.110. - Declaring dog nuisance; notice and effect.

When a complaint has been made by two or more people or by any peace officer that any dog within the corporate limits of the City, is a nuisance, by reason of barking, howling, growling, running or charging at or after any person or vehicle, or destroying or molesting private or public property, or roaming or running at large upon private or public property, or for any other reason affecting public peace, security, health, quietude, welfare or safety, such dog may be declared by the Animal Services Manager to be a public nuisance, and written notice of such declaration shall be delivered to the person owning or having charge or control of such dog; and thereafter such a dog shall be securely tied or kept in an enclosure or on a leash, and may be impounded and adopted or destroyed by the Animal Services Manager, if running at large.

Sec. 5.14.120. - Disturbing the peace.

It is unlawful for any person owning, controlling or having in his care or keeping any animal, whether licensed or unlicensed, to suffer, permit or allow said animal to disturb the peace and comfort of any person by any persistent barking, howling or crying, or to otherwise physically interfere with the reasonable enjoyment of life or property.
