La Verne Municipal Code Ch. 12.23 Storm Drain Facilities

The city council finds that the completion of a city-wide storm drain system is a benefit to all new construction within the city. This chapter shall establish methods of financing the construction of the required storm drain facilities other than facilities provided through approval of subdivision or parcel maps.

The boundaries of the storm drain facilities area are established as the city limits of the city, including any properties annexed to the city subsequent to the effective date of the ordinance codified in this chapter.

The city engineer shall determine what storm drain facilities are required to be constructed for each new development within the city. Such determination may be based upon a hydrology report furnished by the developer, the city's storm drain master plan, or such other method as determined by the city engineer.

Each developer shall construct the required facilities within their development and such other facilities as may be required to provide a complete and workable storm drain system.

Storm drain fees shall be collected from applicants for building permits in accordance with the schedule of fees as established from time to time by resolution of the city council.

Fees collected as required by Section 12.23.050 shall be deposited in the general fund.

The city council may direct the expenditure of funds from the general fund for construction of storm drain facilities as set forth in the "Master Plan of Storm Drains," or other facilities as may be deemed necessary for the benefit of the city.

Nothing in this chapter shall require the city council to enter into any agreement, nor shall the city council be prohibited from entering into any agreement deemed to be in the best interest of the city.
