§ 12.20.010. Removal or relocation—Required when.

Every public works permit relative to an encroachment shall be subject to the provision that in the event of any future public improvement, pursuant to any law of the state or ordinance or resolution of the city providing for such improvement, necessitating the relocation or removal of such encroachment, the permittee shall relocate or remove the same at his or her own expense. In the event the street superintendent shall serve on the permittee a written demand specifying the place of relocation, or that the encroachment must be removed from the street within fifteen days or removal must be commenced. The permittee must commence such relocation within the fifteen days stated in the demand and thereafter diligently prosecute the same to completion.

§ 12.20.020. Removal or relocation—Permit revocation.

All public works permits pertaining to any form of encroachment shall be revocable upon five days' notice and the encroachment must be removed or relocated as may be specified by the street superintendent within a reasonable time but not to exceed fifteen days.

§ 12.20.030. Removal or relocation—Procedure.

In the event an encroachment required removal or relocation in the opinion of the city council, the street superintendent shall give notice to the owner, occupant or person in possession of the encroachment or to any other person causing or suffering the encroachment to exist, to remove or relocate same to the satisfaction of the city. The street superintendent may immediately remove from any city street an encroachment which obstructs or prevents the public from using such streets, and in the event an encroachment is not removed or relocated within fifteen days after notice, the street superintendent may remove same and charge the cost thereof to such permittee, and if necessary bring civil action to collect same.

§ 12.20.040. Encroachment permit fee.

The city council in its discretion may determine an annual fee to be charged for encroachment permits.

§ 12.20.050. Public liability insurance required.

The city in its discretion may determine that as a condition precedent for the granting of a permit for an encroachment, the permittee deposit with the city clerk a policy of public liability insurance in an amount to be determined by the street superintendent.
