§ 12.16.010. Applicability.

The provisions of this chapter, together with Chapters 12.04, 12.08 and 12.20, are applicable to driveways, curbs and sidewalks.

§ 12.16.020. General policy.

Driveways, curbs and sidewalks are to be constructed pursuant to the Standard Specifications of Public Works Construction, and/or the standards and specifications of the city, and/or as specified in this chapter, maintained and repaired by the adjacent property owners even though the same are one public property. The city shall set the lines and grades for all sidewalks, curbs and driveways without expense to the property owner.

§ 12.16.030. Driveways.

Every driveway, entrance or exit connecting a street with private property shall be constructed or established in accordance with the Standard Specifications of Public Works Construction and/or the standard specifications of the city. No driveway shall be constructed or established within six feet (1.83 meters) of any fire hydrant.

§ 12.16.040. Sidewalks—Obstructions.

In accordance with Section 12.20.010 of this title, any obstruction on any sidewalk shall be unlawful unless a public works permit has been obtained therefor.

§ 12.16.050. Sidewalks—Location.

Sidewalks shall be constructed or established the same distance from the curb as other sidewalks in the same block. When there are no sidewalks established in a block, sidewalks shall be adjacent to the curb. The city may, however, at its discretion, approve exceptions to this location requirement and issue a special permit for the exception.

§ 12.16.060. Unlawful to permit defective sidewalk or curb.

It shall be unlawful for any person to suffer or permit any sidewalk or curb abutting and in front of any property owned by the person to become, be or remain defective or out of repair, or to become, be or remain dangerous to the users thereof for any reason, or to become, be or remain an obstruction or impediment to normal, customary and usual pedestrian or vehicular traffic, after ten days' notice to the person of the defective, dangerous or objectionable state or condition of disrepair of the sidewalk or curb.

§ 12.16.070. Materials.

Unless otherwise specified, all curbs, gutters, sidewalks and driveways shall be constructed with Class B concrete. All concrete used shall be in conformance with Section 201 of the Standard Specifications for Public Works Construction.

§ 12.16.080. Construction specifications.

A. Sidewalks. Concrete sidewalks shall be as provided in subsection 303-5 of the Standard Specifications for Public Works Construction, and/or the standard specifications of the city.

B. Curbs and Gutters. Concrete curbs and gutters shall be constructed as provided in subsection 303-5 of the Standard Specifications for Public Works Construction, and/or the standard specifications of the city. Class B mortar shall not be permitted.

C. V-type Curbs. Concrete curbs shall be placed on a subgrade in accordance with subsection 301-1 of the Standard Specifications for Public Works Construction, and/or the standard specifications of the city.

D. Driveways. Driveways shall be constructed in accordance with subsection 303-5.1.2 of the Standard Specifications for Public Works Construction.

§ 12.16.120. Repairs and replacement.

The contractor shall repair all work damaged during construction. Where work requires repairs before acceptance, the repairs shall be made by removing and replacing entire sections and not by refinishing the damaged section.

§ 12.16.130. Inspections and approval of work.

The subgrade and forms shall be approved by the street superintendent before any concrete is placed. No work shall be considered as accepted which may be defective in its construction or deficient in any of the requirements of these specifications. The contractor shall be required to correct any and all imperfections before the final acceptance of the work. In case the contractor shall neglect or refuse to remove any rejected work or material after written notice to do so shall have been served upon him or her by the street superintendent such rejected work or material shall be removed and replaced by the street superintendent at the expense of the contractor. The contractor shall remove all surplus material and rubbish from the work after its completion before he makes application for acceptance of the work.
