19.01.010 - Adoption of the Uniform Housing Code.

There is hereby adopted by the city of La Mesa for the purpose of providing the minimum requirements for the protection of life, limb, health, property, safety and welfare of the general public, and the owners and occupants of residential buildings and provide for the inspection thereof, the Uniform Housing Code, 1997 Edition, as published by the International Conference of Building Officials, one of which is on file in the office of the city clerk and is available for public inspection as required by law.

19.01.020 - Repealing of previous ordinance.

All ordinances or parts of ordinance in conflict or inconsistent with the provisions of this chapter are hereby repealed; except that this appeal shall not affect or prevent the prosecution or punishment of any person for an act done or committed in violation of any ordinance hereby replaced prior to the date of this chapter.

19.01.030 - Housing advisory and appeals board.

Section 203, which is part of the Uniform Housing Code, adopted by reference in Section 19.01.010 hereof, is hereby amended to read as follows:

Section 203. Housing Advisory and Appeals Board.

The Board of Appeals established under Section 204 of the Uniform Administrative Code, shall act as the Board of Appeals for the Uniform Housing Code.

19.01.040 - Violations.

Section 204, which is a part of the Uniform Housing Code, adopted by reference in Section 19.01.010 hereof, is hereby amended to read as follows:

SECTION 204 VIOLATIONS.

No person, firm, or corporation, whether as owner, lessee, sublessee, or occupant, shall erect, construct, enlarge, alter, repair, move, improve, demolish, equip, use, occupy or maintain any building or premises, or cause or permit the same to be done, contrary to or in violation of any of the provisions of this Code or any order issued by the Building Official hereunder.

Any person, firm or corporation violating any of the provisions of this Code shall be guilty of a misdemeanor and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violations of any of the provisions of this Code are committed, continued or permitted, and upon conviction of any such violations, such person shall be punishable by a fine of not more than five hundred dollars ($500) or by imprisonment for not more than six months, or by such fine and imprisonment.

19.01.050 - Constitutionality.

If any section, subsection, sentence, clause or phrase of this chapter is for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this chapter. The council of the city of La Mesa hereby declares that it would have passed this chapter and each section, subsection, sentence, clause and phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, or phrases be declared unconstitutional.

If any provision of this chapter or application thereof to any person or circumstances is held invalid, such invalidity shall not affect other provisions or applications, and to this end the provisions of this chapter are declared to be severable.
