15.52.010 - Imposing easements by recorded covenant.

A. Any landowner(s) may create an easement for parking, ingress, egress, emergency access, light and air access, landscaping or open space purposes by submitting a properly executed covenant signed by all owners of the property to be benefitted, and burdened, by said easement.

B. All the real property benefitted or burdened by the covenant shall be in common ownership.

C. The covenant shall be effective when recorded and shall act as an easement pursuant to Chapter 3 (commencing with Section 801) of Title 2 of Part 2 of Division 2 of the Civil Code, except that it shall not merge into any other interest in the real property. Section 1104 of the Civil Code shall be applicable to conveyance of the affected real property.

D. Owner shall provide the city with detailed maps and legal description of the respective areas of benefit or burden satisfactory to the city engineer and designating the city's project or approval number for same. City shall be provided with conformed copies of all recorded documents involved.

E. Covenants executed and recorded pursuant hereto shall be enforceable by the successors in interest to the real property benefitted by the covenant.
