§ 13.04.010. Bond.

Any person, firm, association, or corporation desiring to open, excavate or dig any trench or opening in any of the public streets, alleys, parks, places, courts and ways in the city, shall, before commencing any such work, deposit with the city clerk, a good and sufficient bond or undertaking in the sum of five hundred dollars, to be approved by the board of trustees of the city, conditioned that any such person, firm, association or corporation doing any of said work shall put said streets back in the same condition and repair as they were prior to any such work being done, or that such person, firm, association or corporation will pay to the city the reasonable value of putting said streets back in the same condition and repair as they were prior to any such work being done, and none of such work shall be done until said bond shall be so filed and approved.

§ 13.04.020. Return to original condition—Supervision.

Any opening, trench or excavation so made shall be filled up and closed and the said streets or other place shall again be placed in the same condition as prior to the making of such opening, trench or excavation, by any such person, firm, association or corporation opening, excavating or digging any such trench or opening and shall be done under the supervision of the superintendent of streets and to his entire satisfaction.

§ 13.04.030. Time limitation—Length.

The work for which any excavation, digging up or opening shall be made shall be prosecuted with due diligence, and so as not to obstruct the travel on any street or other place more than is actually necessary to perform such work, and no more than three hundred feet in length shall be dug up, excavated or opened by any such person, firm, association or corporation at any one time or at any one place.

§ 13.04.040. Failure to restore—Debt.

In case any opening or trench shall not be filled up and closed and the street again placed in the same condition as prior to the making of any such trench, opening or excavation by any such person, firm, association or corporation the superintendent of streets shall cause the same to be filled and said street put in as good repair as prior to such opening, digging or excavating, and the cost and expense of filling such excavation, trench or opening, and restoring the street or other place to its condition prior to making such excavation, trench, or opening shall be deemed a debt due the city from such person, firm, association or corporation making or causing the same to be made, and the surety on the bond provided for in Section 13.04.010 shall be held for the payment of the reasonable cost of restoring said streets or other places to a condition of good repair as they were prior to such opening, digging or excavating.

§ 13.04.050. Tunneling size limitation.

No tunneling larger than a hole eight inches in diameter shall be permitted in or under any portion of any street in the city.

§ 13.04.060. Excavation illumination.

All trenches, ditches, excavations and obstructions of any and every kind in any street, alley, place, court or way shall be properly protected by red lights placed thereon at night to warn persons of danger.

§ 13.04.070. Violation—Penalty.

Any person, firm, association or corporation who opens, or causes to be opened, in any street, lane, alley, park, court or place in the city, any trench, ditch or excavation without having fully complied with the conditions of this chapter or who violates any of the provisions of this chapter, shall be deemed guilty of a misdemeanor, and upon conviction thereof, shall be punished as provided in Chapter 1.04.
