8.16.010 - Covering wells, cesspools and other excavations.

It is unlawful, and punishable as a misdemeanor as provided in Section 1.12.030 of this code, for any person who owns or has under his control any real property on which is located any abandoned septic tank, well, pit or other abandoned excavation any of which are dangerous to human life or limb, where said tank, well, pit or other excavation is more than five (5) feet in depth and less than four (4) feet in width at its greater dimension, to fail to cover or cap it or to fence it securely. "Securely" means to such extent that the danger no longer exists.
