Sec. 4-5-701. - Leash required.

No person owning or having charge, care or custody of any dog shall cause, fail to curb, or allow the same to run at large upon any highway, street, alley, sidewalk, schoolyard, common area, trail, open space or other public place, or upon any private property or premises other than his or her own without written consent of the owner or leasee of such land, unless such dog is restrained by a substantial leash, not to exceed six feet in length, and in the charge of a person competent to restrain such dog. This section does not apply to an approved dog park where it is authorized to run your dog(s) off leash, nor does it apply to those situations enumerated under Section 4-5-707 of this chapter.

Sec. 4-5-702. - Trespassing.

No person owning or having charge, care or custody of any animal shall permit, or fail to prevent by proper confinement or control, such animal to trespass or be upon any private property of another person without the consent of such person.

Sec. 4-5-703. - Property damage.

A. No person owning or having charge, care or custody of any animal shall permit, because of their failure to confine or control their pet, such animal to damage or destroy the property of any person other than that of the owner of such animal.

B. Parkways comprising the area between the street and sidewalk shall be included as private property, for the purpose of this chapter.

Sec. 4-5-704. - Female dogs during breeding period.

During the breeding period, female dogs shall be confined in a building or secure enclosure in such a manner that they cannot come into contact with other animals, except for planned breeding.

Sec. 4-5-705. - Running on owner's premises.

The provisions of this chapter do not prohibit dogs from running at large on the premises of the owner or person having charge of such dog nor do they prohibit dogs, other than unspayed female dogs during the breeding period, from running at large on any property with permission of the owner of such property.

Sec. 4-5-706. - Reserved.

Sec. 4-5-707. - Working dogs.

A working dog, performing acts such as herding under the control and supervision of owner or handler, shall not be considered as unleashed while performing his or her duties. A hunting, obedience, tracking or show dog shall not be considered unleashed while performing in a formalized field trial, exercise show, or when considered on duty and working as a hunting or tracking dog.

Sec. 4-5-708. - Tying animals to objects.

No person shall tie any animal to any stationary object, or any shrub or tree growing along any public sidewalk, public place or street of the City; nor shall any person leave any animal on any private property, whether or not such animal is tied up, other than the property of the owner or person who has custody or control of such animal without the permission of the owner of the private property.

Sec. 4-5-709. - Animal noises prohibited.

It shall be unlawful for any person to keep, maintain or permit on any lot, parcel or land or premises under his or her control any animal which by any sound or cry shall disturb the peace and comfort of the inhabitants of the neighborhood or interfere with the reasonable and comfortable enjoyment of life or property. Notwithstanding the foregoing, barking dogs shall be governed by regulations set forth in Chapter 12 of this division.

Sec. 4-5-710. - Excreta nuisance prohibited.

It shall be unlawful for the owner or person having charge, custody or control of any animal to permit, either willfully or through failure to exercise due care or control, any such animal to commit any nuisance by leaving its excreta, and to allow such nuisance to therefore remain on any public sidewalk, public park or any other public property or on any improved private property other than that of the owner or person who has custody or control of such animal.
