Sec. 4-12-401. - Public nuisance declared.

Any camping facility or encampment established in violation of this chapter is declared to be a public nuisance, as defined by Section 4-11-109 of this Code, and the City is authorized to abate the nuisance and remove camp facilities, camp paraphernalia, and any encampments pursuant to the abatement and notice procedures outlined herein and authorized by law.

Sec. 4-12-402. - City Manager administrative authority.

The City Manager or his or her designee may develop and adopt administrative regulations that are consistent with the terms and prohibitions of this chapter. This shall include all policies and procedures for the abatement of unlawful encampments, including the policies and procedures for ensuring safe and prompt removal of the nuisance while meeting procedural safeguards required by the City, state or federal law.

Sec. 4-12-403. - Violations, penalties, and enforcement.

Violations of this chapter may be prosecuted as misdemeanors subject to the fines and custody provisions outlined in Section 4-13-201 of this Code.
