Sec. 5-3-101. - Created.

There is hereby created and established a Planning Commission in and for the City.

Sec. 5-3-102. - Composition.

The Planning Commission shall be comprised of the same number of members as there are members of the City Council. All Commission members shall be residents of the City.

Sec. 5-3-103. - Appointment.

Each member of the City Council shall appoint one member to the Planning Commission, who shall serve at the pleasure of the member of the City Council who appointed such commissioner, subject to Section 1- 4-203.

Sec. 5-3-104. - Compensation and expenses.

Each member of the Planning Commission shall receive as compensation as defined by separate resolution of the City Council.

Sec. 5-3-105. - Secretary.

The secretary of the Planning Commission shall be the Director of Community Development or such other person as may be designated by the City Council.

Sec. 5-3-106. - Reserved. Sec. 5-3-107. - Meetings and procedures.

A.

The Planning Commission shall meet regularly at least once each month, on a day and place to be fixed by the City Council, and shall hold such other meetings as from time-to-time shall be called in the manner and form required by law, including the provisions of Division 15 of Title 1.

B.

The meetings of the Planning Commission shall be subject to and governed by the rules and regulations for commissions and committees set forth in Chapter 2 of Division 4 of Title 1 of the Code.

Sec. 5-3-108. - Powers and duties.

A.

The Planning Commission shall have the following powers and duties provided by law:

1.

To recommend to the proper officers of the City, plans for the regulation of the future growth and development and beautification of the City in respect to its public buildings, works, streets, traffic, transportation, infrastructure, grounds and vacant lots;

2.

To recommend to the proper officers of the City, plans consistent with the future growth and development of the City in order to secure to the City and its inhabitants, sanitation, proper service of all public utilities, shipping and transportation facilities;

3.

To make recommendations to any public authorities or any corporation or individuals of said City with reference to the location of any proposed buildings, structures or works;

4.

To recommend to the proper officers of the City the approval or disapproval of maps, plans, divisions or subdivisions of lands. Every such map or plan shall, prior to its final approval or disapproval by the proper officers of the City, be submitted to said Planning Commission for its recommendations thereon to such officers;

5.

To do such other things as shall be necessary to carry out the provisions herein authorized and to undertake the study for, preparation and recommendation of a general plan as required by law, covering a comprehensive, long-term, general plan for the physical development of the City and of any land outside its boundaries which in the Commission's judgment bears relation to the development of the City;

6.

To hear and determine all applications for use permits, conditional permits and variances and adjustments not considered by the Zoning Administrator;

To perform those tasks required by the City Council and to do those things otherwise required of a Planning Commission acting as the Planning Agency of a City, including, without being limited to, reporting and recommending upon amendments to the zoning districts and regulations of the City and annexations to the City and the periodic review of the capital improvement program of the City.

B.

The decisions of the Planning Commission shall be final in all matters except as otherwise provided by law.
