§ 7.44.010. Definitions.

For the purpose of this chapter:

"County"

includes all the territory within the boundaries of the county and outside the corporate limits of the city of Bishop;

"Health officer"

means the Inyo County health officer or his duly authorized representative;

"Milk products plant"

means any building or establishment where market milk is received, handled or processed, prior to being sold, offered for sale, distributed, or held in possession for sale or distribution.

§ 7.44.020. Prohibitions.

It is unlawful for any person, firm or corporation to produce, sell, offer for sale, distribute, or have in possession for sale or distribution within the county any milk, cream or fluid derivatives of milk for human consumption as such, unless such products conform to the standards of production, grading, labeling, and distribution as set forth by the provisions of Division 15 of the Agricultural Code of the state and amendments thereto and the rules and regulations of the State Department of Agriculture for its enforcement.

§ 7.44.030. Inspection service.

The health officer shall be responsible for establishing and administering a milk inspection service, approved by the State Director of Agriculture, for the purpose of carrying out the provisions of this chapter.

§ 7.44.040. Milk products plant—Within county—Inspection fee.

Any person, firm or corporation operating a milk products plant within the county shall pay an inspection fee not to exceed three mills for each gallon of graded market milk received or handled. The fee shall be payable during the first week of January, April, July and October of each year, and each payment shall be the amount due for the quarter-year period preceding the due date.

§ 7.44.050. Milk products plant—Outside county—Inspection fee.

Any person, firm or corporation operating a milk products plant outside of the county and purchasing wholesale market milk, to be sold as graded market milk, from any producer within the county, shall pay an inspection fee not to exceed three mills for each gallon of milk received or handled. The fee shall be payable during the first week of January, April, July and October of each year, and each payment shall be the amount due for the quarter-year period preceding the due date.

§ 7.44.060. Inspection fee—Disposition.

All moneys collected from inspection fees shall be placed in the county treasury in the special public health fund, and shall be used for expenses incurred in the execution of this chapter.

§ 7.44.070. Milk products plant, dairy farm—Permit required.

It is unlawful for any person, firm or corporation to operate a milk products plant or dairy farm within the county, without first obtaining a permit from the health officer. Application for the permit must be in writing. Such permit expires on June 30th of each year and may be renewed on the first day of July of each year. Permits issued under the provision of this chapter may be revoked by the health officer upon violation of any of the provisions of this chapter. The permits may also be revoked when, in the judgment of the health officer, the milk or cream supply in question has become a public menace. Before revocation of any permit issued under this chapter, the holder of the permit shall be given a hearing before the health officer to show cause why the permit should not be revoked.

§ 7.44.080. Violation—Penalty.

Any person, firm or corporation violating any of the provisions of this chapter is guilty of a misdemeanor, and upon conviction thereof, shall be punished by a fine not to exceed three hundred dollars or by imprisonment in theCounty Jail not to exceed six months, or by both such fine and imprisonment.
