§ 3.42.010. Intent to use trademark logo.

It is the intent of the City of Indian Wells to register and use in commerce that certain logo as set forth herein as a trademark/service mark, including for any and all purposes pertaining to City matters, affairs and business.

§ 3.42.020. Trademarks are city property.

As trademarks, the following City of Indian Wells trademark logos and marks, and any subsequently adopted marks and logos ("City's marks"), are the personal property of the City. The City may control how the City's marks are used, as well as prevent other persons and entities from using them to confuse, deceive or mislead the public or to otherwise cause the public to believe that such use of the City's marks is authorized or sponsored by, or affiliated with the City.

§ 3.42.030. Penalties.

(a) It shall be unlawful (and a misdemeanor) for any person or entity to use the City's marks, or any confusingly similar imitation thereof, without City authorization on any audio/visual, written, printed or other material that is designed, calculated, intended or likely to confuse, deceive or mislead the public or to otherwise cause the public to believe such material to be an official City publication or other item, or sponsored, affiliated with, or authorized by the City, and no person shall circulate or distribute any such material in the City. Any person violating this Chapter shall be guilty of a misdemeanor.

(b) Any person or entity that violates this Chapter shall be subject to a fine not exceeding $1,000 and not less than $100 for each and every offense and for each day the City marks are unlawfully used. Each of the City's marks, or confusingly similar imitation thereof, so used shall constitute a separate offense under this Chapter.
