Article I

17-1 Established; composition, direction and control. There is hereby established in

the city a department of police, which shall be known as the Police Department of the City of Imperial. The police department shall be under the direction and control of the chief of police, and shall consist of the chief and such policemen as are appointed as provided in this chapter. (Ord. 142)

17-2 Appointment and removal of policemen; extra policemen. The city council shall

appoint policemen, who shall have the full power and authority of peace officers, and such policemen shall be removable at the pleasure of the city council. The chief of police shall, whenever directed by the city council, appoint extra policemen for a limited time to be stated in the appointment, subject to the approval of the city council, which police officers shall have full power and authority of peace officers during their terms of office. 17-3 Peace officer recruitment and training.

a) QUALIFICATION: The City of Imperial declares that it desires to qualify to receive aid from the State of California under the provisions of Chapter I of Title IV, Article 3, of the California Penal Code.

b) ADHERENCE TO STANDARDS: Pursuant to section 13522 of said

Chapter I, the City of Imperial, while receiving aid from the State of California, pursuant

to Chapter I, will adhere to the standards for recruitment and training established by the California Commission on Peace Officer Standards and Training. (Ord. 456)

17-3.5 Designation of Reserve Officer as Peace Officer. Pursuant to California Penal Code Section 832.6 (b), the Chief of Police, with the consent of the City Council, may appoint a reserve city police officer as a peace officer with full powers and duties provided by Penal Code Section 830.1, provided said reserve officer has been issued a Level 1 Reserve Officer Certificate prior to January 1, 1981. Article II. Unclaimed Property

17-4 Unclaimed Property. Any unclaimed property in the possession or under the

control of the Imperial Police Department shall be held by the Department for a period of at least six (6) months. (Ord. 469)

17-5 Recovery by owner. If the owner appears within six (6) months, after receipt of

the property by the Police Department, proves his ownership of the property, and pays all reasonable charges, the Police Department shall restore the property to him. (Ord. 469)

17-6 Sale of unclaimed property. After expiration of the six (6) month period, the

Chief of Police with the prior approval of the City Council, is hereby authorized and empowered to sell at public auction to the highest bidder for cash such unclaimed property. (Ord. 469)

17-7 Notice of sale. Before making any sale, the Chief of Police shall give notice of

the time and place of sale, which notice shall also briefly describe the articles or property to be sold, and such notice shall be published once in a newspaper of general circulation published in Imperial County and circulated in the City of Imperial at least five (5) days before the time fixed for the sale. 17-8 Disposition of proceeds. The proceeds derived from the sale of any unclaimed

property shall be paid into the general fund of the City. Any property remaining unsold after being offered at such public auction may be destroyed or otherwise disposed of by the public agency. (Ord. 469)
