8.60.010 - Registration of pest control businesses.

It is unlawful for any person to advertise, solicit, or operate as a pest control business in the county unless the person is registered for the current calendar year as a pest control business with the Imperial County Agricultural Commissioner. The application for registration shall be in a form prescribed by the commissioner and shall be accompanied by the fee established pursuant to Section 8.60.050.

(a) The application for a pest control business shall contain the information contained in Section 11732 of the California Food and Agricultural Code (FAC). Operations of the registrant, cancellation, revocation, refusal or suspension of registration, and appeals therefrom shall be governed by Sections 11733 through 11741, inclusive, of FAC, as such sections now exist or may hereafter be amended.

(b) The application for a maintenance gardener pest control business licensed under California Food and Agricultural Code section 11704 shall contain the information contained in Section 11732 of the California Food and Agricultural Code. Operations of the registrant, cancellation, revocation, refusal or suspension of registration, and appeals therefrom shall be governed by Sections 11733 through 11741, inclusive, of the California Food and Agricultural Code, as such sections now exist or may hereafter be amended.

(c) The application for a structural pest control business shall contain the information contained in Sections 15204, for Branch 2 or 3 licensees, and 15204.5, for Branch 1 licensees, of the California Food and Agricultural Code. Operations of the registrant, suspension of registration, and appeals therefrom shall be governed by Sections 15202 through 15205, inclusive, of the California Food and Agricultural Code, as such sections now exist or may hereafter be amended.

8.60.012 - Registration of farm labor contractors.

It is unlawful for any person to operate as a farm labor contractor in the county unless the person is registered, pursuant to California Labor Code Section 1695(a)(8), for the current calendar year as a farm labor contractor with the Imperial County Agricultural Commissioner. The application for registration shall be in a form prescribed by the commissioner and shall be accompanied by the fee established pursuant to Section 8.60.050.

8.60.020 - Registration of pest control aircraft pilots.

It is unlawful for any person to act as a pest control aircraft pilot in the county without first registering for the current calendar year with the Imperial County Agricultural Commissioner. The application for registration shall be in a form prescribed by the commissioner and shall be accompanied by the fee established pursuant to Section 8.60.050. Registration and renewals thereof, refusal, revocation or suspension of registration shall be governed by Sections 11921 through 11924, inclusive, of the California Food and Agricultural Code, as such sections now exist or may hereafter be amended.

8.60.030 - Registration of pest control advisers.

No person shall act, or offer to act, as an agricultural pest control adviser without first registering for the current calendar year with the Imperial County Agricultural Commissioner. The application for registration shall be in a form prescribed by the commissioner and shall be accompanied by the fee established pursuant to Section 8.60.050. Registration and renewals thereof, refusal, revocation or suspension of registration shall be governed by Sections 12031 through 12035, inclusive, of the California Food and Agricultural Code, as such sections now exist or may hereafter be amended.

8.60.040 - Terms of registration.

Registrations required by this chapter shall be effective for a period of one year or portion thereof. All registrations shall expire on December 31 of each year and may be renewed annually.

8.60.050 - Collection of fees.

Fees will be assessed under the authority granted by California Food and Agricultural Code (FAC) Sections 11734, 11923, 12034, 15204, 15204.5, and California Labor Code Section 1695(b). A fee schedule will be adopted by resolution of the Board of Supervisors periodically which will be available at the County of Imperial's website under Agricultural Commissioner. Maximum allowable fees will be adopted, when specified in FAC.
