92414.01 - Public benefit. ¶
In the interest of the county of Imperial and for public benefits including, but not limited to, health and safety, law enforcement services, and the greater good of the residents of the county, a public benefit program is herewith established.
The program under direction of the planning director shall secure from all applicants a public benefit service. This may be in the form of a fee, equipment, services or any combination of the above.
In order to implement this program uniformly, the planning director shall secure the input from Imperial Valley Emergency Communication Authority (NECA).
The planning director shall have the authority to negotiate with any applicant/permittee for a local benefit agreement. This may be in the form of a written contract/agreement or a development agreement or such other instrument acceptable to counsel. Regardless of the vehicle, used the final agreement shall be reviewed and approved by the planning commission and their decision shall be final.
The board of supervisors herewith authorizes the planning commission to enter into such agreements.

Division 26 - SEISMIC SAFETY
Chapter 1 - EARTHQUAKE HAZARD REDUCTION IN EXISTING BUILDINGS*
92601.00 - Short title. ¶
The short title of this chapter shall be "The Unreinforced Masonry Ordinance."

92601.01 - Purpose.
The purpose of this chapter is to promote public safety and welfare by reducing the risk of death or injury that may result from the effects of earthquakes on unreinforced masonry bearing wall buildings constructed prior to October 1, 1973. Such buildings have been widely recognized for sustaining life-hazardous damage, including partial or comp1ete collapse during moderate to strong earthquakes.
The ordinance codified in this chapter was enacted pursuant to the requirements of the Government Code of the state of California, Title 2, Division 1, Chapter 12.2, Section 8875 et. seq. The provisions of this chapter are intended as minimum standards for structural seismic resistance established primarily to reduce the risk of life loss or injury. Compliance with these standards will not necessarily prevent loss of life or injury or prevent earthquake damage to rehabilitated buildings. This chapter does not require alteration of existing electrical, plumbing, mechanical or fire safety systems unless they constitute a hazard to life or property.
This chapter provides systematic procedures and standards for identification and classification of unreinforced masonry bearing wall buildings based on their present use. Priorities, time periods and standards are also established under which these buildings are required to be structurally analyzed and anchored. Where the analysis finds deficiencies, this chapter requires the building to be strengthened or demolished.
Qualified historical buildings shall comply with the State Historical Building Code (SHBC) established under Part 8, Title 24, of the California Administrative Code.

92601.02 - Scope.
The provisions of this chapter shall apply to all buildings constructed or under construction prior to October 1, 1973, or for which a building permit was issued prior to October 1, 1973, which on the effective date of the ordinance codified in this chapter have unreinforced masonry bearing walls as defined herein.
Exception. This division shall not apply to detached one- or two-family dwellings and detached apartment houses containing less than five dwelling units and used solely for residential purposes.

92601.03 - Definitions.
For purposes of this chapter, the applicable definitions in Sections 2302 and 2312 of the Uniform Building Code shall apply.
"Essential building" means any building housing a hospital or other medical facility having surgery or emergency treatment areas; fire or police stations; municipal government disaster operation and
communication centers.
"High risk building" means any building, not classified an essential building, having an occupant load of one hundred (100) or more, as determined by Section 3302(a) of the U.B.C.
Exception. A high risk building shall not include the following:
1.
Any building having exterior walls braced with masonry crosswalls or wood frame crosswalls spaced less than forty (40) feet apart in each story. Crosswalls shall be full story height with a minimum length of one and one-half times the story height;
2.
Any building used for its intended purpose, as determined by the building official, for less than twenty (20) hours per week.
"Low risk building" means any building, not classified as an essential building, having an occupant load of less than twenty (20) occupants as determined by Section 3302(a) of the U.B.C.
"Medium risk building" means any building, not classified as a high risk building or an essential building, having an occupant load of twenty (20) occupants or more as determined by Section 3302(a) of the U.B.C.
"Unreinforced masonry bearing wall" means a masonry wall having all of the following characteristics:
1.
Provides the vertical support for a floor or roof;
2.
The total superimposed load is over one hundred (100) pounds per linear foot;
3.
The area of reinforcing steel is less than fifty percent (50%) of that required by Section 2407(h) of the U.B.C.

92601.04 - Rating classification.
The rating classifications shown in Table No. 761-A set out in Section 92601.11, are established and each building within the scope of this chapter shall be placed in one such rating classification by the building official. The total occupant load of the entire building as determined by Section 3302(a) of the U.B.C. shall be used to determine the rating classification.
Exception. For the purpose of this chapter, portions of building constructed to act independently when resisting seismic forces may be placed in separate rating classifications.

92601.05 - General requirements. ¶
The owner of each building within the scope of this chapter shall cause a structural analysis of the building to be made by a civil or structural engineer or architect licensed by the state of California. If the building does not meet the minimum earthquake standards specified in this chapter, the owner shall either cause it to be structurally altered to conform to such standards or cause the building to be demolished.
The owner of a building within the scope of this chapter shall comply with the requirements set forth above by submitting to the building official for review within the stated time limits:
A.
Within two hundred seventy (270) days after the service of the order, a structural analysis, which is subject to approval by the building official, and which shall demonstrate that the building meets the minimum requirements of this chapter;
B.
Within two hundred seventy (270) days after the service of the order, the structural analysis and plans for the proposed structural alterations of the building necessary to comply with the minimum requirements of this chapter;
C.
Within one hundred twenty (120) days after service of the order, plans for the installation of wall anchors in accordance with the requirements specified in Section 92601.06(C); or
D.
Within two hundred seventy (270) days after the service of the order, plans for the demolition of the building.
After plans are submitted and approved by the building official, the owner shall obtain a building permit, commence and complete the required construction or demolition within the time limits set forth in Table No. 761-B, set out in Section 92601.11. These time limits shall begin to run from the date the order is served in accordance with Section 92601.07(A) and (B).
Owners electing to comply with subsection C of this section are also required to comply with subsection B or D of this section; provided, however, that the two hundred seventy (270)-day period provided for in such subsection B and D of this section and the time limits for obtaining a building permit, commencing construction and completing construction for complete structural alterations or building demolition set forth in Table No. 761-B, set out in Section 92601.11, shall be extended in accordance with Table No. 761-C. Each
such extended time limit, except the time limit for commencing construction, shall begin to run from the date the order is served in accordance with Section 92601.06. The time limit for commencing construction shall commence from the date the building permit is issued.

92601.06 - Administration. ¶
A.
Service of Order. The building official shall issue an order, as provided in subsection B of this section, to the owner of each building within the scope of this chapter in accordance with the minimum time periods for service of such orders set forth in Table No. 761-C, set out in Section 92601.11. The minimum time period for the service of such orders shall be measured from the effective date of this chapter. Upon receipt of a written request from the owner, the building official shall order a building to comply prior to the normal service date for such building set forth in this section.
B.
Contents of Order. The order shall be in writing and shall be served either personally or by certified or registered mail upon the owner as shown on the last equalized assessment, and upon the person, if any, in apparent charge or control of the building. The order shall specify that the building has been determined by the building official to be within the scope of this chapter and, therefore, is required to meet the minimum seismic standards of this chapter. The order shall specify the rating classification of the building and shall be accompanied by a copy of Section 92601.05 which sets for the owner's alternatives and time limits for compliance.
C.
Appeal Form Order. The owner or person in charge or control of the building may appeal to the building appeals board the building official's initial determination that the building is within the scope of this chapter. Such appeal shall be filed with the board within sixty (60) days from the service date of the order described in subsection B of this section. Any such appeal shall be decided by the board no later than sixty (60) days after the date that the appeal is filed. Such appeal shall be made in writing upon appropriate forms provided therefor, by the building official and the grounds thereof shall be stated clearly and concisely. Each appeal shall be accompanied by a filing fee as set forth in the code.
Appeals or requests for slight modifications from any other determinations, orders or actions by the building official pursuant to this chapter, shall be made in accordance with the normal appeal procedures established in this code.
D.
Recordation. At the time that the aforementioned order is served, the building official shall file with the office of the county recorder a certificate stating that the subject building is within the scope of this chapter. The certificate shall also state that the owner thereof has been ordered to structurally analyze the building and to structurally alter or demolish it where it is not found to comply with this chapter.
If the building is found not to be within the scope of this chapter, or as a result of structural alterations or any analysis is found to be structurally capable of resisting minimum seismic forces required by this chapter or is demolished, the building official shall file with the office of the county recorder a certificate terminating the status of the subject building as being classified within the scope of this chapter.
E.
Enforcement. If the owner or other person in charge or control of the subject building fails to comply with any order issued by the building official pursuant to this chapter within any of the time limits set forth in Section 92601.03, the building official shall order the entire building vacated and remain vacated until such order has been complied with. If compliance with such order has not been accomplished within ninety (90) days after
the date the building has been ordered vacated, or by such additional time as may have been grantee by the buildings appeals board, the building official may order demolition of the building in accordance with the Abatement of Dangerous Buildings provisions of this code, Chapter 91008.

92601.07 - Analysis and design.
A.
General. Every structure within the scope of this division shall be analyzed and constructed to resist minimum total lateral seismic forces assumed to act nonconcurrently in the direction of each of the main axes of the structure in accordance with the following equation:

The value of "IKCS" need not exceed the values set forth in Table No. 76l-D, set out in Section 92601.11, based on the applicable rating classification of the building.
B.
Lateral Forces on Elements of Structures. Parts or portions of structures shall be analyzed and designed for lateral loads in accordance with subsection A of this section and Section 23l2(e) of the Uniform Building Code but not less than the value from the following equation:

For the provisions of this subsection, the product of "IS" need not exceed the values as set forth in Table No. 761-E.
Exception. Unreinforced masonry walls in buildings not having a rating classification of I may be analyzed in accordance with Section 92601.08.
The value of "Cp" need not exceed the values set forth in Table 761-F, set out in Section 92601.11.
C.
Anchorage and Interconnection. Anchorage and interconnection of all parts, portions and elements of the structure shall be analyzed and designed for lateral forces in accordance with Table No. 761-F, set out in Section 92601.11 and the equation Fp = ZICpSWp as modified by Table No. 76l-E. Minimum anchorage of masonry walls to each floor or roof shall resist a minimum force of two hundred (200) pounds per linear foot acting normal to the wall at the level of the floor or roof.
D.
Level of Required Repair. Alterations and repair required to meet the provisions of this chapter shall comply with all other applicable requirements of the Uniform Building Code unless otherwise specifically provided for in this chapter.
E.
Required Analysis.
1.
General. Except as modified herein, the analysis and design relating to the structural alteration of existing structures within the scope of this chapter shall be in accordance with the analysis specified in Chapter 23 of the U.B.C.
2.
Continuous Stress Path. A complete, continuous stress path from every part or portion of the structure to the ground shall be provided for the required horizontal forces.
3.
Positive Connections. All parts, portions or elements of the structure shall be interconnected by positive means.
F.
Analysis Procedure.
1.
General. Stresses in materials and existing construction utilized to transfer seismic forces from the ground to parts or portions of the structure shall conform to those permitted by the Uniform Building Code and those materials and types of construction specified in Section 92601.08.
2.
Connections. Materials and connectors used for interconnection of parts and portions of the structure shall conform to the Uniform Building Code. Nails may be used as part of an approved connector.
3.
Unreinforced Masonry Walls. Except as modified herein, unreinforced masonry walls shall be analyzed as specified in Sections 2406, 2407, and 2408 of the U.B.C. to withstand all vertical loads as specified in Chapter 23 of the Uniform Building Code in addition to the seismic forces required by this chapter. The fifty percent (50%) increase in the seismic force factor for shear walls as specified in Section 2407(h)4F of the Uniform Building Code may be omitted in the computation of seismic loads to existing shear walls.
No allowable tension stress will be permitted in unreinforced masonry walls. Walls not capable of resisting the required design forces specified in this chapter shall be strengthened or shall be removed and replaced.
Exceptions.
1.
Unreinforced masonry walls in buildings not classified as a Rating Classification I pursuant to Table No. 761A, set out in Section 92601.11, may be analyzed in accordance with Section 92601.08.
2.
An unreinforced masonry wall which carries no design loads other than its own weight may be considered as veneer if it is adequately anchored to new supporting elements.
G.
Combination of Vertical and Seismic Forces.
1.
New Materials. All new materials introduced into the structure to meet the requirements of this section which are subjected to combined vertical and horizontal forces shall comply with Section 2303(f) of the U.B.C.
2.
Existing Materials. When stresses in existing lateral force resisting elements are due to a combination of dead loads plus live loads plus seismic loads, the allowable working stress specified in the Uniform Building Code may be increased one hundred percent (100%). However, no increase will be permitted in the stresses allowed in Section 92601.08, and the stresses in members due only to seismic and dead loads shall not exceed the values permitted by Section 2303(d) of the Uniform Building Code.
3.
Allowable Reduction of Bending Stress by Vertical Load. In calculating tensile fiber stress due to seismic forces required by this chapter, the maximum tensile fiber stress may be reduced by the full direct street due to vertical dead loads.

92601.08 - Materials of construction.
A.
General. All materials permitted by the Uniform Building Code, including their appropriate allowable stresses and those existing configurations of materials specified herein, may be utilized to meet the requirements of this chapter.
B.
Existing Materials.
1.
Unreinforced Masonry Walls. Unreinforced masonry walls analyzed in accordance with this section may provide vertical support for roof and floor construction and resistance to lateral loads. The facing and backing of such walls shall be bonded so that not less than four percent of the exposed face area is composed of solid headers extending not less than four inches into the backing. The distance between adjacent full-length headers shall not exceed twenty-four (24) inches vertically or horizontally. Where the backing wythes shall be bonded together with separate headers whose area and spacing conform to the foregoing.
Tension stresses due to seismic forces normal to the wall may be neglected if the walls do not exceed the height to thickness ratio in Table No. 761-G, set out in Section 92601.11, and the in-plane shear stresses due to seismic loads as set forth in Table No. 761-J.
If the wall height-thickness ratio exceeds the specified limits, the wall may be supported by vertical bracing members designed in accordance with Section 92601.07. The deflection of such bracing member at design loads shall not exceed one-tenth of the wall thickness.
Exception. The wall may be supported by flexible vertical bracing members designed in accordance with Section 92601.07(B) if the deflection at design loads is not less than one-quarter nor more than one-third of the wall thickness.
All vertical bracing members shall be attached to floor and roof construction for their design loads independently of required wall anchors. Horizontal spacing of vertical bracing members shall not exceed onehalf the unsupported height of the wall nor ten (10) feet.
The wall height may be measured vertically to bracing elements other than a floor or roof. Spacing of the bracing elements and wall anchors shall not exceed six feet. Bracing elements shall be detailed to minimize the horizontal displacement of the wall by components of vertical displacements of the floor or roof.
2.
Existing Roof, Floors, Walls, Footings, and Wood Framing. Existing materials including wood shear walls utilized in the described configuration may be used as part of the lateral load resisting system, provided that the stresses in these materials do not exceed the values shown in Table No. 761-H, set out in Section 92601.11.
C.
Strengthening of Existing Materials. New materials including wood shear walls may be utilized to strengthen portions of the existing seismic resisting system in the described configurations provided that the stresses do not exceed the values shown in Table No. 761-I, set out in Section 92601.11.
D.
Alternate Materials. Alternate materials, designs and methods of construction may be approved by the building official in accordance with the provisions of the Uniform Building Code.
E.
Minimum Acceptable Quality of Existing Unreinforced Masonry Walls.
1.
General Provisions. All unreinforced masonry walls utilized to carry vertical loads and seismic forces parallel and perpendicular to the wall plane shall be tested as specified in this subsection. All masonry quality shall equal or exceed the minimum standards established herein or shall be removed and replaced by new materials. Alternate methods of testing may be approved by the building official. The quality of mortar in all masonry walls shall be determined by performing in-place shear tests or by testing eight-inch diameter cores. Alternative methods of testing may be approved by the building official. Nothing shall prevent pointing with
mortar of all the masonry wall joints before the tests are first made. Prior to any pointing, the mortar joints must be raked and cleaned to remove loose and deteriorated mortar. Mortar for pointing shall be Type S or N except that masonry cements shall not be used. All preparation and mortar pointing shall be done under the continuous inspection of a registered deputy building inspector. At the conclusion of the inspection, the inspector shall submit a written report to the licensed engineer or architect responsible for the seismic analysis of the building setting forth the result of the work inspected. Such report shall be submitted to the building official for approval as part of the structural analysis. All testing shall be performed in accordance with the requirements specified in this subsection by a testing agency approved by the building official. An accurate record shall be kept of all such tests and of their locations in the building, and these results shall be submitted to the building official for approval as part of the structural analysis.
2.
Number and Location of Test. The minimum number of tests shall be two per wall or line of wall elements resisting a common force, or one per one thousand five hundred (1,500) square feet of wall surface, with a minimum of eight tests in any case. The exact test or core location shall be determined at the building site by the licensed engineer or architect responsible for the seismic analysis of the subject building.
3.
In-Place Shear Tests. The bed joints of the outer wythe of the masonry shall be tested in shear by laterally displacing a single brick relative to the adjacent bricks in that wythe. The opposite head joint of the brick to be tested shall be removed and cleaned prior to testing. The minimum quality mortar in eighty percent (80%) of the shear tests shall not be less than the total of thirty (30) psi plus the axial stress in the wall at the point of the test. The shear stress shall be based on the gross area of both bed joints and shall be that at which movement of the brick is first observed.
4.
Core Tests. A minimum number of mortar test specimens equal to the number of required cores shall be prepared from the cores and tested as specified herein. The mortar joint of the outer wythe of the masonry core shall be tested in shear by placing the circular core section in a compression testing machine with the mortar bed joint rotated fifteen (15) degrees from the axis of the applied load. The mortar joint tested in shear shall have an average ultimate stress of twenty (20) psi based on the gross area. The average shall be obtained from the total number of cores made. If test specimens cannot be made from cores taken, then the shear value shall be reported as zero.
F.
Testing of Shear Bolts. One-fourth of all new shear bolts and dowels embedded in unreinforced masonry walls shall be tested by a special inspector using a torque calibrated wrench to the following minimum torques:
½″ diameter bolts or dowels = 40 foot-lbs.
⅝″ diameter bolts or dowels = 50 foot-lbs.
¾″ diameter bolts or dowels = 60 foot-lbs.
No bolts exceeding three-quarters of an inch shall be used. All nuts shall be installed over malleable iron or plate washer when bearing on wood and heavy cut washers when bearing on steel.
G.
Determination of Allowable Stresses for Design Methods Based on Test Results.
1.
Design Shear Values. Design seismic in-plane shear stresses shall be substantiated by tests performed as specified in subsection (E)(3) and (4) of this section. Design stresses shall be related to test results obtained in accordance with Table No. 761-J. Intermediate value between three and ten (10) psi may be interpolated.
2.
Design Compression and Tension Values. Compression stresses for unreinforced e masonry having a minimum design shear value of three psi shall not exceed one hundred (100) psi. Design tension values for unreinforced masonry shall not be permitted.
H.
Five percent of the existing rod anchors utilized as all or part of the required wall anchors shall be tested in pullout by an approved testing laboratory. The minimum number tested shall be four per floor, with two tests at walls with joists framing into the wall and two tests at walls with joists parallel to the wall. The test apparatus shall be supported on the masonry wall at a minimum distance of the wall thickness from the anchor tested. The rod anchor shall be given a preload of three hundred (300) pounds prior to establishing a datum for recording elongation. The tension test load reported shall be recorded at one-eighth inch relative movement of the anchor and the adjacent masonry surface. Results of all tests shall be reported. The report shall include the test results as related to the wall thickness and joist orientation. The allowable resistance value of the existing anchors shall be forty percent (40%) of the average of those tested anchors having the same wall thickness and joist orientation.
I.
Qualification tests for devices used for wall anchorage shall be tested with the entire tension load carried on the enlarged head at the exterior face of the wall. Bond on the part of the device between the enlarged head and the interior wall face shall be eliminated for the qualification tests. The resistance value assigned the device shall be twenty percent (20%) of the average of the ultimate loads.

92601.09 - Information required on plans.
A.
General. In addition to the seismic analysis required elsewhere in this chapter, the licensed engineer or architect responsible for the seismic analysis of the building shall determine and record the information required by this section on the approved plans.
B.
Construction Details. The following requirements with appropriate construction details shall be made part of the approved plans:
1.
All unreinforced masonry walls shall be anchored at the roof level by tension bolts through the wall as specified in Table No. 761-I, set out in Section 92601.11, or by approved equivalent at a maximum anchor spacing of six feet.
All unreinforced masonry walls shall be anchored at all floors with tension bolts through the walls or by existing rod anchors at the maximum anchor spacing of six feet. All existing rod anchors shall be secured to the joists to develop the required forces. The building official may require testing to verify the adequacy of the embedded ends of existing rod anchors. Tests when required shall conform to Section 92601.08(H).
When access to the exterior face of the masonry wall is prevented by proximity of a building, wall anchors conforming to Items 5 and 6 in Table No. 761-I, set out in Section 92601.11, may be used.
Alternative devices to be used in lieu of tension bolts for masonry wall anchorage shall be tested as specified in Section 92601.08(I).
2.
Diaphragm chord stresses of horizontal diaphragms shall be developed in existing materials or by addition of new materials.
3.
Where trusses and beams other than rafters or joists are supported on masonry, ledgers or columns shall be installed to support vertical loads of the roof or floor members.
4.
Parapets and exterior wall appendages not capable of resisting the forces specified in this chapter shall be removed, stabilized or braced to insure that the parapets and appendages remain in their original position.
5.
All deteriorated mortar joints in unreinforced masonry walls shall be pointed with Type S or N mortar (masonry cements shall not be used). Prior to any pointing, the wall surface must be raked and cleaned to remove loose and deteriorated mortar. All preparation and pointing shall be done under the continuous inspection of a special inspector certified to inspect masonry or concrete. At the conclusion of the project, the inspector shall submit a written report to the building official setting forth the portion of work inspected.
6.
Repair details shall be prepared for any cracked or damaged unreinforced masonry wall required to resist forces specified in this chapter.
C.
Existing Construction. The following existing construction information shall be made part of the approved plans:
1.
The type and dimension of existing walls and the size and spacing of floor and roof members;
2.
The extent and type of existing wall anchorage to floors and roof;
3.
The extent and type of parapet corrections, if any, which were performed in accordance with the Uniform Building Code;
4.
Accurately dimensioned floor plans and masonry wall elevations showing dimensioned openings, piers, wall thickness and heights;
5.
The location of cracks or damaged portions of unreinforced masonry walls requiring repairs;
6.
The type of interior wall surfaces and whether reinstalling or anchoring of ceiling plaster is necessary;
7.
The general conditions of the mortar joints and whether the joints need pointing.

92601.10 - Real property taxation.
In accordance with Article 13A, Section 2 of the Constitution of the state of California, that portion of the real property reconstruction or improvement necessary for compliance with this chapter shall not be considered "newly constructed" for property taxation purposes during the first fifteen (15) years following that reconstruction or improvement.

Division 27 - ABATEMENT AND REMOVAL OF ABANDONED, WRECKED, DISMANTLED OR INOPERATIVE VEHICLES
Chapter 1 - ABANDONED VEHICLE ABATEMENT
92701.00 - Abandoned vehicles as nuisances.
In addition to and in accordance with the determination made and the authority granted by the state of California under Section 22660 of the California Vehicle Code (VC) to remove abandoned, wrecked,
dismantled, or inoperative vehicles or parts thereof as public nuisances, the county of Imperial makes the following findings and declarations:
The accumulation and storage of abandoned, wrecked, dismantled, or inoperative vehicles or parts thereof on private or public property not including highways creates a condition tending to reduce the value of private property, to promote blight and deterioration, to invite plundering, to create fire hazards, to constitute an attractive nuisance creating a hazard to the health and safety of minors, to create a harborage for rodents and insects, to be injurious to the health, safety, and general welfare. Therefore, the presence of an abandoned, wrecked, dismantled or inoperative vehicle or parts thereof, on private or public property, not including highways except as expressly permitted in this chapter, constitutes a public nuisance which may be abated as such in accordance with the provisions of this chapter.

92701.01 - Definitions.
As used in this chapter, the following words and phrases are defined as set out in this section:
"Highway" means a way or place of whatever nature, publicly maintained and open to the use of the public for purposes of vehicular travel. Highway includes street.
"Owner of the land" means the owner of the land on which the vehicle, or parts thereof, is located, as shown on the last equalized assessment roll.
Owner of the vehicle" means the last registered owner and legal owner of record.
"Vehicle" means a device by which any person or property may be propelled, moved, or drawn upon a highway except a device moved by human power or used exclusively upon stationary rails or tracks.
"Public Property" does not include highways.

92701.02 - Exceptions.
This chapter shall not apply to:
A.
A vehicle, or part thereof, which is completely enclosed within a building in a lawful manner where it is not visible from the highway or other public or private property;
B.
A vehicle, or part thereof, which is stored or parked in a lawful manner on private property in connection with the business of a licensed dismantler, licensed vehicle dealer, or a junkyard or when such storage or parking is necessary to the operation of a lawfully conducted business or commercial enterprise.
Nothing in this section authorizes the maintenance of a public or private nuisance as defined under provision of law other than Chapter 10 (commencing with Section 22650) of Division 11 of the Vehicle Code and this chapter.

92701.03 - Nonexclusivity of regulation. ¶
This chapter is not the exclusive regulation of abandoned, wrecked, dismantled, or inoperative vehicles within the unincorporated area of the county. It shall supplement and be in addition to the other regulatory codes, statutes, and ordinances heretofore or hereafter enacted by the county of Imperial, the state, or any other legal entity or agency having jurisdiction.

92701.04 - Officer designated. ¶
Except as otherwise provided herein, the provisions of this chapter shall be administered and enforced by the vehicle abatement officer as designated by the (designated agency head responsible for abandoned vehicle abatement operations in the designated county). In the enforcement of this chapter, such officers and deputies may enter upon private or public property to examine a vehicle, or parts thereof, obtain information as to the identity of a vehicle, and remove or cause the removal of a vehicle or part thereof declared to be a nuisance pursuant to this chapter.

92701.05 - Act of abandonment - Infraction. ¶
It is unlawful and an infraction for any person to abandon, store, leave, or permit the abandonment, storing, or leaving of any licensed or unlicensed vehicle or parts thereof which is abandoned, wrecked, dismantled or inoperative upon any private property or public property, including highways, within the county for a period in excess of seventy-two (72) or more consecutive hours unless such vehicle or parts thereof is completely enclosed within a building in a lawful manner where it is not plainly visible from the street or other public or private property, or unless such vehicle is stored or parked in a lawful manner on private property in connection with the business of a licensed dismantler or licensed vehicle dealer or a junkyard.

92701.06 - Authority of vehicle abatement officer. ¶
Upon discovering the existence of an abandoned, wrecked, dismantled or inoperable vehicle, or parts thereof, on private property or public property within the county, the vehicle abatement officer shall have the authority to cause the abatement and removal thereof in accordance with the procedure described in this chapter.

92701.07 - Authority of private contractor.
When the county has contracted with or granted a franchise to any person or persons, such person or persons shall be authorized to enter upon private property or public property to remove or cause the removal of a vehicle or parts thereof declared to be a nuisance pursuant to this chapter.

92701.08 - Administration costs. ¶
The county shall, from time to time, determine and fix an amount to be assessed as administrative costs (excluding the actual cost of removal of any vehicle or part thereof) under this chapter.

92701.09 - Abatement notice of intention.
A.
A ten (10) day notice of intention to abate and remove the vehicle, or parts thereof, as a public nuisance shall be mailed by registered or certified mail to the owner of the land as shown on last equalized assessment roll and to the last registered and legal owner of record, unless the vehicle is in such condition that identification numbers are not available to determine ownership. The notices of intention shall be in substantially the following form:
"NOTICE OF INTENTION TO ABATE
AND REMOVE AN ABANDONED, WRECKED, DISMANTLED, OR INOPERATIVE VEHICLE OR PARTS THEREOF AS A PUBLIC NUISANCE"
(Name and address of owner of the land)
"Based on a site inspection of your property, the vehicle abatement officer has determined that conditions exist at the property legally known as ___________, Assessor's Parcel Numbers ___________ which are not in compliance with Section 92701 the Imperial County Land Use Ordinance. On the subject property there exists an (or parts of an) abandoned, wrecked, dismantled, or inoperative vehicle registered to ___________, license number ___________, which constitutes a public nuisance pursuant to the provision of (Chapter of Division 27 of Title 9 Imperial County)." The Imperial County Tax Assessor's "Current Roll" identifies the above person(s) as the current owners of the subject property.
"You are hereby notified to abate said nuisance by the removal of said vehicle (or said parts of a vehicle) within ten (10) days from the date of mailing of this notice, and upon your failure to do so the same will be abated and removed by the county and the costs thereof, together with administrative costs, assessed to you as owner of the land on which said vehicle (or said parts of a vehicle) is located."
"As owner of the land on which said vehicle (or said parts of a vehicle) is located, you are hereby notified that you may, within ten (10) days after the mailing of this notice of intention, request a public hearing and if such a request is not received by the Imperial County within such ten (10)-day period, the county vehicle abatement officer shall have the authority to abate and remove said vehicle (or said parts of a vehicle) as a public nuisance and assess the costs as aforesaid without a public hearing. You may submit a sworn written statement within such ten (10)-day period denying responsibility for the presence of said vehicle (or said parts of a vehicle) on said land, with your reasons for denial, and such statement shall be construed as a request for a hearing at which your presence is not required. You may appear in person at any hearing requested by you or the owner of the vehicle or, in lieu thereof, may present a sworn written statement in time for consideration at such hearing."
B.
A notice of intention to abate shall not be required if: (1) the property owner and the owner of the vehicle has signed releases authorizing removal and waives further interest in the vehicle or part thereof, or (2) all the following conditions are satisfied:
1.
The vehicle or part thereof is inoperable due to the absence of a motor, transmission, or wheels and is incapable of being towed:
2.
The vehicle or part thereof is valued at less than three hundred dollars ($300.00) by the vehicle abatement office:
3.
Imperial County has determined that the vehicle or part thereof is a public nuisance presenting an immediate threat to public health or safety;
4.
the property owner has signed a release authorizing the removal and waiving further interest in the vehicle or part thereof; and
5.
the vehicle is located upon a parcel that is either zoned for agricultural use or is not improved with a residential structure containing one or more dwelling units.
If a vehicle is removed pursuant to subdivision (2), prior to final disposition, the registered or legal owner shall be notified of the intent to dispose of the vehicle or parts thereof. If the vehicle or part thereof is not claimed and removed from the scrapyard, automobile dismantler's yard or public disposal area within twelve (12) days after the notice to dispose of vehicle is mailed, final disposition may proceed.

92701.10 - Public hearing requested. ¶
Upon request by the owner of the vehicle or owner of the land received by the county's vehicle abatement officer within ten (10) days after the mailing of the notices of intention to abate and remove, a public hearing shall be held by the (planning director or his designated subordinate as hearing officer) on the question of abatement and removal of the vehicle, or parts thereof, as an abandoned, wrecked, dismantled or inoperative vehicle, and the assessment of the administrative costs and cost of removal of the vehicle, or parts thereof, against the property on which it is located.
If the owner of the land submits a sworn written statement-denying responsibility for the presence of the vehicle on his/her land within such ten (10)-day period, said statement shall be construed as a request for a hearing, which does not require his/her presence. Notice of the hearing shall be mailed, by registered mail, at
least ten (10) days before the hearing to the owner of the land and to the owner of the vehicle, unless the vehicle is in such condition that identification numbers are not available to determine ownership. If such a request for hearing is not received within said ten (10) days after mailing of the notice of intention to abate and remove, the county shall have the authority to abate and remove the vehicle, or parts thereof, as a public nuisance without holding a public hearing.

92701.11 - Public hearing procedure. ¶
All hearings under this chapter shall be held before the (planning director or his designated subordinate as hearing officer), which shall hear all facts and testimony deemed pertinent. Said facts and testimony may include testimony on the condition of the vehicle, or part thereof, and the circumstances concerning the vehicle's location on the private property or public property. The (planning director or his designated subordinate as hearing officer) shall not be limited by the technical rules of evidence. The owner of the land on which the vehicle is located may appear in person at the hearing or present a written statement in time for consideration at the hearing, and deny responsibility for the presence of the vehicle on the land, with reasons for such denial. The (hearing officer) may impose such conditions and take such other action as it deems appropriate under the circumstances to carry out the purpose of this chapter. This may delay the time for removal of the vehicle, or part thereof, if, in the opinion of the hearing officer, the circumstances justify the delay.
At the conclusion of the public hearing, the (hearing officer) may find that a vehicle, or part thereof, has been abandoned, wrecked, dismantled or is inoperative on private or public property, and by resolution order the same removed from the property as a public nuisance and disposed of as provided in this chapter and determine the administrative costs and the cost of removal to be charged against the owner of the parcel of land on which the vehicle, or part thereof, is located.
The order requiring removal shall include a description of the vehicle, or part thereof, and the correct identification number and license number of the vehicle, if available at the site.
If it is determined at the hearing that the vehicle was placed on the land without the consent of the land owner and that (s)he has not subsequently acquiesced in its presence, the (hearing officer) shall not assess costs of administration or removal of the vehicle against the property upon which the vehicle is located or otherwise attempt to collect such costs from such land owner.
If an interested party makes a written presentation to the (hearing officer), but does not appear, (s)he shall be notified in writing of the decision.

92701.12 - Appeals. ¶
Any interested party may appeal the decision of the hearing office by filing a written notice of appeal with the said hearing office within five days after this decision. Such appeal shall be heard by the board of supervisors, which may affirm, amend or reverse the order or take other action deemed appropriate. The clerk of the board of supervisors shall give written notice of the time and place of the hearing to the appellant and those persons specified in Section 92701.11. In conducting the hearing the board of supervisors shall not be limited by the technical rules of evidence.

92701.13 - Vehicle disposal. ¶
A.
Five days after adoption of the order declaring the vehicle or parts thereof to be a public nuisance or five days from the date of mailing of notice of the decision, as required by Section 92701.10, whichever date is later, the vehicle or parts thereof may be disposed of by removal to a scrapyard or automobile dismantler's yard. If such commercial sites are not available or are inadequate the vehicle/or parts may be disposed at any public disposal, which will accept the same. After a vehicle has been removed, it shall not thereafter be reconstructed or made operable unless it is a vehicle which qualifies for either horseless carriage license plates or historical vehicle license plates pursuant to Section 5004 of the California Vehicle Code, in which case the vehicle may be reconstructed or made operable.
B.
With respect to abandoned or inoperable vehicles located upon a parcel that is either: (1) zoned for agricultural use or (2) not improved with a residential structure containing one or more dwelling units, prior to the final disposition of a vehicle or part therefore where notice pursuant to Section 92701.09 was not required and for which evidence of registration was recovered pursuant to Section 92701.14 the enforcement officer or a contractor or franchisee under Section 92701.07 shall provide notice to the registered and legal owners of intent to dispose of the vehicle or part, and if the vehicle or part is not claimed and removed within twelve (12) days after the notice is mailed, from a location specified in Vehicle Code 22662, final disposition may proceed. Neither the county nor a contractor or franchise under this chapter shall be liable for damage caused to a vehicle or part thereof for removal pursuant to this chapter.

92701.14 - Notice to Department of Motor Vehicles. ¶
Within five days after the date of removal of the vehicle or parts thereof, notice shall be given to the department of Motor Vehicles by the persons authorized to remove the vehicle identifying the vehicle or parts thereof removed. At the same time there shall be transmitted to the department of Motor Vehicles any evidence of registration available, including registration certificates, certificates of title, and license plates.

92701.15 - Cost recovery.
If the administrative costs and the costs of removal which are charged against the owner of a parcel of land pursuant to Section 92701.11 are not paid within thirty (30) days of the date of the order, such cods shall be assessed against the parcel of land pursuant to Government Code Section 25845 or 38773.5 and shall be transmitted to the tax collector for collection. Said assessment shall have the same priority as other county taxes.

92701.16 - Refusal to abate - Infraction.
It is unlawful and an infraction for any person to fail or refuse to remove an abandoned, wrecked, dismantled, or inoperative vehicle or part thereof, or refuse to abate such nuisance when ordered to do so in accordance with the abatement provisions of this chapter or state law, where such state law is applicable.

92701.17 - Severability. ¶
Should any section, subsection, paragraph, clause, or phrase of this chapter for any reason be held to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this chapter.

Division 28 - MAINTENANCE OF CEMETERIES Chapter 1 - MAINTENANCE OF CEMETERIES
92801.00 - Statement of purpose and intent. ¶
The board of supervisors has determined that persons who fail to maintain private, historic, public, or other cemeteries in a manner consistent with the standards set forth in this division may cause health and safety problems and bring decay, blight and nuisance to the residents and surrounding land uses of Imperial County. Furthermore, maintaining such facilities in substandard conditions may violate other federal, state or county rules and regulations, and at the very least, causes grief to families who have relatives and friends interred. This division shall take effect immediately, and shall apply to all cemeteries and cemetery districts located within the unincorporated area of the county of Imperial, unless otherwise specified herein. The board of supervisors has further determined that imposing fines and penalties, and/or causing maintenance to be performed and an assessment applied upon persons who fail to meet these standards will serve to deter such persons from creating this nuisance.

92801.01 - Definitions.
A.
Unless otherwise stated herein, the terms used in this division shall have same meaning as stated within Division 14 of Title 9, "cemetery", as used in this division, has the same definition as in Section 91401.02 of these ordinances that has endowment care funding pursuant to Health and Safety Code Section 8725.
B
"Enforcement officer", as used in this division, means persons designated by the director of planning and development services department or his or her designee to enforce the provisions of this chapter.
C.
"Local enforcement entities", as used in this division, means any city, county, or city and county in this state.

92801.02 - Standards.
All cemetery properties subject to this division shall be landscaped, maintained, and improved in a manner meeting the standards set forth herein. Failure to meet any one or all of those standards may be considered to be a violation of this division.
A.
Ground Cover Maintenance.
1.
Minimum Ground Cover for Travel Surfaces and Parking Lots.
a.
All travel surfaces shall be clearly defined and surfaced with an all-weather surface which, at a minimum, shall be Class II base compacted and graded and periodically treated to minimize dust.
b.
All parking lots or similar areas shall be surfaced as in subsection (A)(1)(a) of this section.
2.
Minimum Ground Cover for Gravesites.
a.
Gravesites located outside of a county indigent burial section shall be covered with an approved permanent ground cover. Approved ground cover shall be any of the following:
i.
Grass;
ii.
Solid marble slate;
iii.
Shrubs; and/or
iv.
Such other material deemed acceptable by the director of planning and development services.
b.
Gravesites located within a county indigent burial section shall be covered with a ground cover deemed acceptable to the director of planning and development services. Such ground cover shall, at a minimum, be sufficient to reduce potential dust emissions and ensure interred remains do no become exposed.
3.
Minimum Ground Cover for Other Areas.
a.
All other cemetery areas not otherwise specified herein that are not located within a county indigent burial section or an undeveloped section of a cemetery shall be developed and maintained with an approved ground cover, which shall be any of the following:
i.
Grass;
ii.
Sand, gravel or similar material, provided it is installed and maintained in an aesthetic design, as determined by the director of planning and development services; and/or
iii.
Such other material deemed acceptable by the director of planning and development services.
b.
Other cemetery areas not otherwise specified herein that are located within a county indigent burial section or an undeveloped section of a cemetery shall be covered with a ground covered deemed acceptable to the director of planning and development services. Such ground cover shall, at a minimum, be sufficient to reduce potential dust emissions.
4.
Markers, Monuments, and Other Identifiers. All gravesites shall be mapped in blocks and plots in accordance with Division 8 of the California Health and Safety Code and the California Professional Land Surveyor's Act.
a.
Every cemetery shall be responsible for placing physical markers delineating the blocks and plots of each gravesite located with the cemetery. Markers shall be placed as soon as possible, but not less than thirty (30) days after the internment of remains on a gravesite requiring delineation.
b.
Monuments, plaques, headstones, and other identifiers may also be placed on gravesites in accordance with Division 8 of the California Health and Safety Code, and any applicable cemetery district rules or policies.
c.
All markers, monuments, plaques, headstones, and other identifiers shall be of a material that is durable, weather resistant, of sufficient weight to deter removal with ease, and be aesthetically designed.
5.
Plants/Trees.
a.
Every cemetery shall have a minimum of five trees per acre. These trees shall be a minimum of fifteen (15) gallons when planted and shall be replaced immediately when dead
b.
Every new cemetery shall plant and maintain a minimum of one tree for every thirty (30) feet along the front of the property.
c.
Existing cemeteries shall plant and maintain a minimum of one tree for every thirty (30) feet along the front of the property, unless an existing cemetery can provide evidence deemed sufficient by the director of planning and development services that there is insufficient space between the front of the property and the interment plots to do so.
6.
Fences, Walls and Other Ornamental Features.
a.
For new cemeteries and expansion areas of existing cemeteries, all fences, gates, and walls shall be constructed of approved materials, such as masonry, wrought iron or other approved metallics. Chain link may only be used for side or rear boundaries, and shall be commercial grade and coated with a green or black finish.
b.
Existing cemeteries may utilize the fencing, gate, and wall materials specified in subsection A(6)(a). In addition, existing cemeteries may utilize existing fencing, shrubs, trees, and other natural barriers if deemed acceptable by the director of planning and development services.
7.
Maintenance. Cemeteries shall be fully maintained at all times. This shall include the removal of all trash, weeds, and nonused materials. The ground cover shall be trimmed, mowed or otherwise cleaned on a routine basis. All trees or shrubs shall be trimmed or pruned regularly.

92801.03 - Inspection and enforcement. ¶
A.
Authority to Inspect. Upon the presentation of proper credentials, the enforcement officer, or his or her designee, is authorized to enter upon any property or premises to ascertain whether pertinent county ordinances and applicable state laws are being obeyed. The enforcement officer may make any examinations or surveys as are necessary to perform the enforcement officer's responsibilities. The enforcement officer may take photographs, samples or other physical evidence. If an owner, occupant, lessee, or agent refuses permission to enter or inspect, the enforcement officer may seek an administrative inspection warrant pursuant to California Code of Civil Procedure Section 1822.50 et seq.
B.
Citations. The enforcement officer or his or her designee(s) have the authority pursuant to Section 1.12.020 of the codified ordinances of the county of Imperial to issue citations against any person, firm or corporation that is in violation of any provision of this title and/or any section, article or regulation of the adopted codes, and may issue a citation to effect compliance with all applicable laws, ordinances, and/or regulations. The citation shall be issued only by duly qualified personnel and upon the format approved by the courts.
C.
Citation Procedures. The enforcement officer, or his or her designee(s), is authorized to issue notices to appear in court as prescribed by Chapter 5(c) of Title 5, Part 2 of the Penal Code, commencing with Section 853.5. If a violator to whom a notice is given fails to give his or her promise to appear, the enforcement officer shall request the assistance of a peace officer to take the individual into custody or shall refer the notice to appear to the district attorney.

92801.4 - Penalties.
A.
It is unlawful to fail to maintain a cemetery at a level less than those standards set forth in this division and/or any other part of this title.
B.
Violations of this division are subject to enforcement action as specified in Division 13 of this title.
C.
Any person violating this title is guilty of a misdemeanor. Each day that the cemetery remains out of compliance with Section 92701.02, in violation of this section remains a separate violation.

92801.5 - Severability.
If any provision of this division is found to be invalid by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

Division 29 - WONDERSTONE AGGREGATE SURFACE MINING PERMIT
Chapter 1 - WONDERSTONE AGGREGATE SURFACE MINING PERMIT PROPOSED PROCESSING PROCEDURE
92901.00 - Purpose of the division.
This division is adopted for the purpose of administrative review and approval of each application for a Wonderstone aggregate surface mining permit to ensure compliance with the applicable surface mining operation provisions of the Wonderstone aggregate specific plan and the Imperial County Land Use Code (Title 9).

92901.01 - Authority of the planning director.
The planning director is granted authority to consider, approve and/or deny a Wonderstone aggregate surface mining permit application. Any party aggrieved by the decision of the planning director may appeal the director's decision to the planning commission, provided any such appeal is filed within ten (10) calendar days from the date of decision and is in accordance with the procedures specified in Sections 90102.04 and 90104.05 of the Imperial County Land Use Code (Title 9).

92901.02 - Administrative process by director.
In order to streamline the review process and clearly delineate the standards and rules, the following administrative procedure is established and shall be followed by the department for processing a Wonderstone aggregate surface mining permit application:
A.
Within ten (10) days of receipt, the application shall either be deemed complete or be returned to applicant in writing if deemed incomplete.
B.
Within thirty (30) days from the date the application is deemed complete, the director shall approve, conditionally approve or deny the Wonderstone aggregate surface mining permit application. The director may continue the decision for up to ten (10) days, if necessary.
C.
The director may approve a Wonderstone aggregate surface mining permit application only if the finding can be made that the surface mining operation complies or will comply with the applicable aggregate surface mining provisions of the Wonderstone aggregate specific plan.
D.
Following the decision of the director there shall be a ten (10) calendar day period during which any aggrieved party may appeal the decision of the director to the planning commission. No construction or other county permits shall be approved until the ten (10) day appeal period has terminated and no appeal has been filed.

92901.03 - Authority of planning commission.
The planning commission, upon appeal, shall have the authority to grant or deny a Wonderstone aggregate surface mining permit. No appeal from the director's decision shall be allowed to the board of supervisors unless and until the commission has reached a decision.

92901.04 - Notice of hearing.
After acceptance of a completed appeal application and the completion of a staff report, the commission shall conduct a public hearing on the Wonderstone aggregate surface mining permit appeal request. The notice and scheduling of the public hearing shall be pursuant to Section 90104.03(C) of this title.

92901.05 - Action on a Wonderstone aggregate surface mining permit.
In approving a Wonderstone aggregate surface mining permit, the planning director, the planning commission and/or the board of supervisors may impose such conditions deemed necessary to enable making the finding that the surface mining operation complies or will comply with the applicable aggregate surface mining provisions of the Wonderstone aggregate specific plan.

92901.06 - Effective date of a Wonderstone aggregate surface mining permit.
The approval of a Wonderstone aggregate surface mining permit shall become final and effective on the eleventh day after the action of the director unless an appeal is filed within ten (10) days from the date of his/her decision.
The approval of a Wonderstone aggregate surface mining permit by the planning commission shall become effective on the eleventh day after the planning commission action granting the Wonderstone aggregate surface mining permit, unless an appeal is filed to the board of supervisors within ten (10) days. The approval of a Wonderstone aggregate surface mining permit by the board of supervisors becomes final on the day of the board's action.

92901.07 - Time limit.
An approved Wonderstone aggregate surface mining permit shall be valid until such time as either:
A.
The Wonderstone specific plan is rescinded;
B.
The Wonderstone aggregate surface mining permit is relinquished by the permittee; or
C.
The Wonderstone aggregate surface mining permit is revoked by the Imperial County planning commission, subject to appeal to the Imperial County board of supervisors.

92901.08 - Revocation/modification.
Any Wonderstone aggregate surface mining permit issued pursuant to this division may be modified or revoked by the planning commission after a duly noticed public hearing in which the planning commission has found that subject Wonderstone aggregate surface mining permit is in violation of the applicable provisions of the Wonderstone aggregate specific plan or the Imperial County Land Use Code (Title 9). The decision of the planning commission may be appealed by the aggrieved party to the Imperial County board of supervisors.
