Chapter 19.61 — CANNABIS FACILITIES

§ 19.61.010. Definitions. ¶
"Cannabis permitted use" has the same meaning as set forth in Section 4.60.020 of this code. (Ord. 2018-1174 § 3)
§ 19.61.020. Cannabis permitted uses. ¶
A. A cannabis permitted use as defined in Section 4.60.020 of this code may only operate in the zone(s) specified in Section 4.60.040 of this code and in compliance with all of the requirements specified in Chapter 4.60 of this code.
B. For zoning districts not specified in Section 4.60.040 of this code, it shall be presumed that the cannabis business and/or use is expressly not permitted and not allowed within that zoning district.
C. This chapter does not apply where preempted by state or federal law. (Ord. 2018-1174 § 3)
§ 19.61.030. Prohibition. ¶
All prohibited activities specified in Section 4.60.240 of this code are prohibited. (Ord. 2018-1174 § 3)
§ 19.61.040. Violations—Penalty. ¶
A. Any use or condition caused or permitted to exist in violation of any provisions of this chapter or Chapter 4.60 shall be and is hereby declared a public nuisance and may be abated by the city pursuant to the procedures set forth in this code.
B. Each violation of this chapter and each day a violation of this chapter continues to exist shall be considered a separate and distinct violation.
C. All means of enforcement authorized under this code and applicable law, including those specified in Chapter 4.60 , may be used to address violations of this chapter.
