§ 7-5.101. Declaration of need and purposes.

The Council hereby declares that it is in the public interest that decorative trees be placed on the public sidewalks in the commercial and/or business areas of the City, including, but not limited to, Pacific Boulevard, at locations to be designated as provided in Section 7-5.102 of this article, for the purposes of aiding in the improvement and beautification of the commercial and business areas. It is further declared that such trees, when so located, will not unreasonably interfere with the rights of the public to use such sidewalks and will be consistent with the dedication of such sidewalks to the public use.

§ 7-5.102. Permits—Issuance—Authorized.

The Chief Administrative Officer is hereby authorized to issue permits from time to time to the Huntington Park Chamber of Commerce, the Huntington Park Junior Chamber of Commerce, or other persons, companies, or organizations as may comply with the provisions of this article and be responsible and trustworthy in the placement and maintenance of such boxed trees on the public sidewalks in connection with a beautification program. The Chief Administrative Officer shall approve the number and location of such trees so as to best serve the public interest.

§ 7-5.103. Permits—Issuance—Conditions.

Permits issued pursuant to the provisions of Section 7-5.102 of this article shall include and be subject to the following provisions:

(a) The Chief Administrative Officer shall approve the type and size of trees to be installed and the type and size of containers for such trees.

(b) The permittee shall maintain such trees and the containers in which the trees are enclosed in good repair and in safe and sightly condition at his or her own expense and to the satisfaction of the Chief Administrative Officer or such City officer or employee as the Chief Administrative Officer may delegate the duty of inspecting such trees.

(c) The permittee shall save the City harmless from any and all losses, claims, or judgments for damages to any person or property arising from, or in any way connected with, the placement, installation, maintenance, or presence of the trees and their containers. In connection with the provisions of this subsection, the permittee shall furnish to the City a policy of liability insurance, showing the City as one of the insured thereunder, in an amount not less than $100,000 for injury to one person and $300,000 for injury to two or more persons, together with property damage coverage in an amount not less than $25,000. Such insurance shall be written by a company satisfactory to the Chief Administrative Officer and in a form satisfactory to the City Attorney, who shall approve the insurance policy. After presenting the insurance policy to the City, the permittee may retain such policy and give the City a certificate of the insurance coverage containing a provision that the insurance will not be canceled except after not less than 30 days' written notice to the City.

(d) The permit shall be revocable on 30 days' prior written notice to the permittee from the Chief Administrative Officer, in which event the permittee shall, at his or her own expense, remove the trees and containers located and installed pursuant to the permit and restore the sidewalks to a neat and clean condition.
