The purpose of this chapter is to provide for local regulation regarding the pasteurization of milk and milk products, consistent with the requirements of the Milk and Milk Products Act of 1947 (Division 15 of the Food and Agricultural Code of the State of California). Nothing herein is intended to conflict with the requirements of state law. (Repealed and reenacted by Ord. 1921, § 1, 1/8/1991) 512-2. Definitions. (a) Fluid Milk Products. “Fluid milk products” is defined as including market cream, concentrated milk, half and half, homogenized market milk, vitamin cream and any other product made by the addition of any substance to market milk or any of these products and used for similar purposes and designated as a fluid milk product by the Health Officer. (Repealed and reenacted by Ord. 1921, § 1, 1/8/1991) (b) Health Officer. “Health Officer” means the Health Officer of the County of Humboldt or his authorized representative. (Repealed and reenacted by Ord. 1921, § 1, 1/8/1991) 512-3. Laboratory Examinations. The Health Officer is authorized to direct or perform all bacteriological and chemical examinations pertaining to dairy and milk inspections. (Repealed and reenacted by Ord. 1921, § 1, 1/8/1991)
512-4. Pasteurization. All market milk, skim milk, and other fluid milk products sold, offered for sale, distributed or in possession for sale in the County shall be pasteurized as provided in the Milk and Milk Products Act of 1947 (Division 15 of the Food and Agricultural Code). This section shall not apply to any milk or cream produced and sold from dairies having fewer cows or goats than that defined as a “dairy farm” in said Milk and Milk Products Act. Nor shall anything in this section be construed to prevent the delivery or sale of Raw Grade "A" milk, not conforming to this section, to a milk products plant for the purpose of pasteurizing the same. (Repealed and reenacted by Ord. 1921, § 1, 1/8/ 1991) 512-5. Penalties. Any person or agent or employee of any person who violates any provision of this chapter, or rules and regulations enacted pursuant thereto, shall be guilty of a misdemeanor, punishable by a fine of not less than Fifty Dollars ($50.00) nor more than One Thousand Dollars ($1,000.00), or by imprisonment in the County jail not more than ninety (90) days, or both such fine and imprisonment. Each and every violation of the provisions of this chapter shall constitute a separate offense.
