Article IV — PAYMENT OF FEE, FEE AMOUNTS, AND USE OF FEES

3210-7. Time for Payment of Fee.

The fee imposed pursuant to this chapter shall be paid to and collected by the County on or before the time of issuance of the building permit provided that, in accordance with subdivision (b) of Government Code section 66007, the fee may be collected at such time. Any fee imposed pursuant to this chapter that must be collected after the issuance of the building permit in accordance with subdivision (a) of Government Code section 66007 shall be paid to and collected by the District. Where the County is to issue a building permit, the person liable for the fee shall submit to the Department of Community Development Services such information as the Department may require to calculate the amount due. If the District is to collect the fee, the Department will forward to the District the amount of the fee to be collected by the District. (Ord. 2437, § 1, 08/24/10)

All funds from fees collected under this chapter and all interest subsequently accrued on these funds shall be deposited with the County Treasurer in a separate account for the specified Fire District named the “ Development Impact Fee;” (Ord. 2437, § 1, 8/24/2010)

3210-8. Fee Amounts.

Fees payable under this chapter shall be payable in those specific amounts designated by the Board of Supervisors and amended from time to time by Board ordinance. The amount payable shall be reduced by the amount of any fee charged to the developer by any other jurisdiction to provide funding for the same fire protection Facilities and Equipment. During the first five calendar years beginning after the adoption of this chapter, the Board may, without further study by the Fire District, adjust the fee amounts one time annually based on the percentage increase in the Engineering News Record Construction Cost Index or a similar index which measures typical construction costs for Facilities and Equipment generally similar to those to be built by the Fire Protection District. 3210-9. Administrative Charge.

The County may charge for its services in administering this chapter an administrative charge of up to three (3) percent of the fees collected by the County pursuant to this chapter, and the County Treasurer may deduct such amount from the District Development impact fee account and credit it to the County general fund in the County

treasury. In the event the District collects the fee pursuant to section 3210-7, the administrative charge by the County shall be not more than one and one-half (1.5) percent. (Ord. 2437, § 1, 8/24/2010)

3210-10. Use of Fees.

With the exception of the administrative charge provided in section 3210-9, all fees collected pursuant to this chapter, including any interest accrued thereon, shall be expended by the District exclusively to plan, design, acquire, or lease Facilities and Equipment for the District to mitigate the impacts attributable to Development. Specifically, the fees shall be used to pay the applicable portion of the costs of land, capital improvements and equipment necessitated by the Development, whether identified by a capital improvement plan or otherwise. Fees remaining unexpended or uncommitted five (5) or more years after deposit shall be subject to the provisions of Government Code section 66001. (Ord. 2437, § 1, 8/24/2010)
