16.32.010 - Tentative and final maps—When required.

A tentative and final map shall be required for all subdivisions creating five or more parcels, five or more condominiums as defined in Section 783 of the Civil Code or a community apartment project containing five or more parcels, or for the conversion of a dwelling to a stock cooperative containing five or more dwelling units, except where any one of the following occurs:

A.

The land before division contains less than five acres, each parcel created by the division abuts upon a maintained public street or highway and no dedications or improvements are required by the legislative body; or

B.

Each parcel created by the division has a gross area of 20 acres or more and has an approved access to a maintained public street or highway; or

C.

The land consists of a parcel or parcels of land having approved access to a public street or highway which comprises part of a tract of land zoned for industrial or commercial development and which has the approval of the governing body as to street alignments and widths; or

D.

Each parcel created by the division has a gross area of not less than 40 acres or is not less than a quarter of a quarter section; or

E.

The land being subdivided is solely for the creation of an environmental subdivision pursuant to California Government Code Section 66418.2.

A parcel map shall be required for those subdivisions described in subdivisions A, B, C, D, and E.

16.32.020 - Parcel maps and tentative parcel maps—When required.

A.

A parcel map shall be filed and recorded for any subdivision, including but not limited to those described in subsections A, B and C of Section 16.32.010, created by short-term leases, terminable by either party on not more than 30 days' notice in writing, of a portion of an operating right-of-way of a railroad corporation defined as such by Section 230 of the Public Utilities Code; provided, however, that upon a showing made to the planning commission based upon substantial evidence that public policy necessitates such a map, this exception shall not apply. Such maps shall meet all of the requirements of the Subdivision Map Act and of this title and shall show all dedications or offers of dedication thereon. The city engineer may require that such dedications or offers of dedication be made by deed in lieu of or in addition to appearing on the map.

B.

When a parcel map may be required by this title, a tentative parcel map shall first be filed with the planning commission. Such map shall meet all of the requirements for tentative maps provided by the Subdivision Map Act and this chapter.

C.

Except where required by the Subdivision Map Act, no parcel map need be filed or recorded whenever the planning commission finds that the proposed division of land meets all requirements as to area, improvement and design, floodwater drainage control, appropriate improved public roads, sanitary disposal facilities, water supply availability, environmental protection, all other requirements of the Subdivision Map Act and any applicable provisions of this title. Provided, however, that a tentative parcel map shall be required before the planning commission shall be empowered to waive the filing and recording of a parcel map under this title.

16.32.030 - Condominiums and community apartment project maps.

A condominium or community apartment project map shall not show the buildings (or the manner in which the buildings or airspace above property shown on map are to be divided). Fees and lot design requirements shall be computed and imposed with respect to such maps on the basis of parcels or lots of the surface of the land shown thereon as included in the project. Condominium and community apartment projects, including but not limited to the design and location of the buildings, shall be subject to the provisions of this title.
