5.24.010 - Responsibility for damage or injury.

A. Every person, firm, corporation or other entity (hereinafter collectively "person") engaged in any profession, occupation, trade, business, contracting or subcontracting operation or any other kind of calling (hereinafter collectively "occupation") involving any hazard or risk of personal injury or property damage shall exercise all due care in the conduct of such occupation and shall be responsible for the consequences of any personal injury or property damage resulting from such occupation and shall defend, indemnify and hold the town free and harmless against all actions, claims, losses, liabilities, or demands and against all costs, expenses and attorneys' fees, accruing on account of or in any way related to or arising from such person's engaging in such occupation. This obligation shall not be qualified or eliminated by any allegation, finding, judgment or verdict that the town or any of its personnel, is responsible for a passively negligent act or omission.

B. Without limiting the generality of the foregoing Section 5.24.010A, for purposes of this Chapter, the businesses of tree surgery, tree trimming, and the felling or dropping of trees shall in all cases be deemed an occupation involving hazard or risk of personal injury or property damage.
